This booklet contains the texts of the Theo van Boven Lectures held in 2014 and 2015. They deal with the subject of defending human dignity by looking at the different roles the human rights defender, the scholar and the human rights NGO can play in achieving this goal. Hina Jilani looks at the opportunities and limitations of human rights defenders in their fight to stand up for the protection of human dignity. Jean Allain discusses the role of the legal scholar in studying contemporary forms of slavery. Finally Aidan McQuade denounces practices of slavery from the perspective of a human rights NGO. The Theo van Boven Lecture Series are organised annually by the Maastricht Centre for Human Rights as a tribute to Theo van Boven, emeritus Professor of International Law at Maastricht University, and formerly Director of the UN Division of Human Rights, member of the Committee on the Elimination of Racial Discrimination and UN Special Rapporteur on Torture. The themes covered by the lectures reflect the wide range of interests of Theo van Boven. This publication is interesting for human rights practitioners, scholars and students.

Be as it is the result of the war on terrorism, foreign military intervention, economic globalisation or otherwise, state conduct increasingly affects the human rights of individuals beyond its own borders. This book provides a comprehensive answer to the question whether existing human rights treaties are applicable in such circumstances. The principal treaties on civil and political rights require states to guarantee certain human rights to persons ‘within their jurisdiction’. What is the meaning of these terms? Are states able to evade the application of these treaties by detaining their opponents on foreign soil rather than within their own borders? Does it make a difference to the applicability of these treaties, whether a victim of an extraterritorial assassination by state agents, was a detainee, who had not been arrested? By contrast, treaties on economic, social and cultural rights tend to specifically to provide that states must strive for the full realisation of these rights through international co-operation. The problem here is that the precise nature and content of this obligation is unclear. For example, what is the extent of states' obligations to contribute to sustainable development in other states? What are their obligations as members of the executive bodies of international financial institutions such as the World Bank and the IMF? This book focuses on the extraterritorial application of four key human rights treaties: the two UN Covenants on Human Rights and the American and European Conventions on Human Rights. It reveals that supervisory bodies are inconsistent in their implementation of these treaties and discusses the pros and cons of both a restrictive and a non-restrictive approach.

Those involved in human rights, whether on a theoretical or a practical level, sometimes cannot help feeling that they are dancing on a tightrope stretched between two high trees above a deep ravine. On one side of the ravine, a jungle stretches out as far as the eye can see; a jungle which is ruled by the laws of the fittest; laws that have no regard for justice and vulnerability. On the other side of the ravine, justice has, in the course of time, changed the laws of the jungle into laws which include and protect vulnerable individuals in society. In this second volume in celebration of Theo van Boven's 65th birthday, a number of Theo's friends try to come to grips with the tension between the `jungle of exclusion' and the `ideal of inclusion', in the full knowledge that Theo has preceded them in a great deal of pioneering work. The volume opens with an interview with Theo van Boven. Topics covered in the present volume include ( inter alia ): pre-20th century bills or rights, Mandelstam as forgotten pioneer of human rights, racial and gender discrimination, the rights of the child and child abuse, the right to reparation, the role of bystanders, globalization of economic power, economic and social rights and the European Union, tobacco use as a human rights issue, illegally obtained evidence, human rights policies, cultural diversity, human rights funding, the African human rights system, follow-up action to state reporting, character of the views of the Human Rights Committee, the Human Rights Committee and gender mainstreaming, the UN Commission on Human Rights, and the International Criminal Court.
