One of the most widespread problems in post-Communist countries is the quality of the judiciary. The book argues that these problems are intimately linked to the legal culture of Communist law, that an understanding of post-Communist judges necessarily requires an understanding of their Communist predecessors. There seems to be a deep continuity in the methods of legal reasoning employed by lawyers in the region of East Central Europe, starting in the era of Stalinism of the 1950's up to the current post-Communist period, which continuity is manifested in the problems of 1990's and 2000's. Communist legal culture and its aftermath provide an interesting analysis of the development of legal culture in a long-lasting system which was intellectually almost completely separated from the outside world. The book targets the judicial ideology, the conception of law, and the judicial self-perceptions, which are phenomena most likely to be contained in the deepest level of legal culture, that most resistant to change.

Une des causes majeures de l’affirmation du pouvoir juridictionnel en Europe réside dans les nouvelles prérogatives accordées aux juges depuis la fin de la Seconde Guerre mondiale : en confiant à certains d’entre eux (en particulier aux juges constitutionnels et européens) la possibilité de contrôler la compatibilité des lois avec les droits et libertés fondamentaux, les démocraties parlementaires ont confié à ces autorités un pouvoir considérable. Pour cette raison, il est apparu indispensable d’étudier ces institutions, leurs pouvoirs respectifs et leurs relations mutuelles. De manière générale, les rapports entre juges constitutionnels et européens sont de type harmonieux. Pourtant, un désaccord profond a divisé ces institutions sur une question de droit précise : existe-t-il des limites à la primauté du droit européen ? En particulier, le droit européen prime-t-il sur les règles constitutionnelles de l’État ? Ces questions n’ayant pas été tranchées par le pouvoir politique lors de la rédaction des traités, les juges y ont apporté leur propre réponse. Pour les juridictions européennes (Cours de Strasbourg et de Luxembourg), le droit européen prime sur l’ensemble du droit national, y compris les règles constitutionnelles des États. En revanche, pour les juges constitutionnels allemand et français, il existe une limite fondamentale à la primauté du droit européen : l’inviolabilité des droits et libertés garantis par la constitution étatique. Ainsi, les juges nationaux ont tenté de préserver, face à l’intégration croissante du droit européen, une parcelle de souveraineté de l’État. Bien plus, ils ont tenté de conserver un pouvoir souverain dans leurs interprétations nationales des droits et libertés. Cependant, la question se pose de savoir s’il revenait aux juges de débattre et de trancher ainsi des questions de souveraineté, questions fondamentales pour l’organisation de l’État démocratique et l’avenir de la construction européenne. International Human Rights Protection, addressed to judges and lawyers, diplomats and civil servants, researchers and students, is based on the author's personal research and personal involvement with a wide range of subjects, such as the basic concepts of civil and social rights, discrimination and affirmative action, issues of procedure and jurisdiction and issues such as the death penalty and the protection of refugees, minorities and victims of armed conflicts. At the universal level, the book introduces the reader to the labyrinth of United Nations Charter-based and treaty-based procedures. As well as an overview of the Inter-American and African systems, it deals at the regional level particularly with the case law of the European Court of Human Rights in Strasbourg, and also looks at the national level at the case law of the US Supreme Court and the South African Constitutional Court. This book adopts a particularly critical approach to the so-called dynamic" interpretation of the European Convention on Human Rights by the Court of Strasbourg. It is the author's feeling that judges in particular those belonging to courts specialising in human rights have a tendency to systematically support interpretations benefitting the applicants while overlooking too easily the far-reaching implications of judgments for society as a whole. He prefers a more balanced and more realistic approach taking into account the difficulties democratic governments face in coping with the challenges of our present time and with the pressing needs of the realities of today's world. Marc Bossuyt has not only a vast academic experience as Professor of International Law (at the University of Antwerp), as Visiting Professor in universities in Africa America and Asia and as a researcher in the field of International Human Rights Protection. He also has extensive administrative experience (as Commissioner General for Refugees and Stateless Persons) diplomatic experience (as Member and Chairperson of United Nations Commissions Committees and Conferences on Human Rights) and judicial experience (as a Judge and President of the Belgian Constitutional Court).
