Le congé pour motif grave soit, en pratique le plus souvent, un licenciement pour motif grave a une place très importante dans la pratique du droit social. Il permet à l'auteur du congé de mettre un terme à la relation de travail sans préavis ni indemnité. C'est la raison pour laquelle il se voit strictement encadré, tant par des règles de forme que par des règles de fond, et ce dans le but de protéger le destinataire qui est bien souvent le travailleur. Le travailleur licencié pour motif grave se trouve, en effet, dans une situation particulièrement délicate puisque du jour au lendemain, il n'a plus de travail, il ne bénéficie ni d'un préavis, ni d'une indemnité compensatoire de préavis et il va, vraisemblablement, se voir sanctionné dans le cadre de l'octroi des allocations de chômage. Un grand nombre de licenciements pour motif grave aboutit donc à des litiges judiciaires. De nombreux auteurs se sont déjà penchés sur le motif grave et la jurisprudence est, elle aussi, particulièrement étoffée. Il n'en demeure pas moins que cette notion et ses conditions d'application continuent à poser de multiples questions dans la pratique. L'ouvrage fait le point sur ce thème en réunissant autour de la question divers praticiens du droit (avocats, magistrats, consultants). Le but est à la fois d'aborder les sujets classiques et incontournables liés au motif grave (notion, notification, délai) pour en donner une synthèse actualisée mais, également, d'approfondir des questions spécifiques en lien avec le thème, qui n'ont à l'heure actuelle pas donné lieu à d'amples développements, et ce dans une approche plus thématique (harcèlement, concurrence, bonnes moeurs, etc.)

Actuele problemen van het arbeidsrecht 8 bevat de geschreven referaten van de gelijknamige lessencyclus, die dit keer geheel gewijd was aan het ontslagrecht. Het meer dan 800 pagina’s tellende werk ambieert een overzicht te brengen van de recente ontwikkelingen op het vlak van het beëindigingsrecht van de arbeidsovereenkomst. De onbetwiste kwaliteit van de bijdragen en het cruciale karakter van de aangesneden thematiek staan allicht borg voor een hoge gebruikswaarde van het boek. De referaten brengen een rijk gevarieerd beeld van de complexiteit van het ontslagrecht. Ze onderstrepen andermaal het wezenlijke karakter van de beëindigingsregels voor de arbeidsrechtelijke bescherming van de werknemers. De bijdragen getuigen echter ook vooral van de alom aanwezige rechtshomogene benadering van het arbeidsovereenkomstenrecht. De grondrechten, de discriminatietoets en het Europese communautaire recht zijn immers niet meer weg te denken uit een eigentijdse analyse van het ontslagrecht.

Het principe van absolute bevrijdende verjaringstermijnen is essentieel om rechtszekerheid voor de schuldenaar en de maatschappij te waarborgen. Nochtans brengt dit principe in uitzonderlijke gevallen ook onbillijke gevolgen met zich mee voor de schuldeiser. Er is dan ook nood aan correctiemechanismen op absolute bevrijdende verjaringstermijnen die een belangenafweging tussen schuldeiser en schuldenaar mogelijk maken en eventuele onbillijke gevolgen corrigeren. Het opzet van dit onderzoek is dan ook om uit een ruimere studie een alternatief systeem van correctiemechanismen te formuleren.Om tot dit laatstgenoemde systeem van correctiemechanismen te komen, start dit onderzoek bij de in overweging te nemen belangen om vervolgens de stap naar een concreet juridisch aanknopingspunt te zetten. Door een rechtsvergelijkende benadering met de Nederlandse gezichtspuntentheorie worden zeven relevante belangen en een onderlinge hiërarchie geformuleerd.De auteur argumenteert dat een aanknopingspunt voor deze belangenafweging naar Belgisch recht ligt in de proportionaliteitstoets van het verbod op rechtsmisbruik. Indien deze rechtsfiguur wordt gehanteerd als aanvullend globaal correctiemechanisme naast de bestaande punctuele correctiemechanismen, komen we tot een systeem van correctiemechanismen dat de partijbelangen voldoende in overweging neemt en bij manifeste onbillijkheden de gewenste correctie doorvoert.

Does a person accused of genocide, crimes against humanity or war crimes before the International Criminal Court (ICC) enjoy the same human rights as a person accused of the same crimes before a national jurisdiction? In other words, to what extent does the ICC have an obligation to respect human rights of a suspect or accused person and, if so, can it do so? The purpose of this book is precisely to answer this question by focusing on the right to interim release of an accused. It seeks to draw attention to this issue and improve the practice of the ICC by presenting a clear legal argument from which key actors, such as defense lawyers, can draw from to enforce their clients’ right to freedom. To this end, it identifies the basis of the ICC’s legal obligation and defines the right to provisional release pending trial. On the basis of this definition, the compliance by the ICC with this obligation is analyzed. Like other authors who examined the question of the applicability of human rights to the ICC, the author of this book considers that the particular context in which the ICC acts must be taken into account when assessing its ability to respect human rights. However, unlike such authors, this book demonstrates that, regarding the right to interim release, this particular context is not necessarily an obstacle that defense lawyers must uncritically accept. The practice of the International Criminal Tribunal for the former Yugoslavia (ICTY) offers multiple examples of successful provisional releases in cases where a State agrees to offer guarantees for the reception of an accused in its territory. This book therefore argues for the obligation of the ICC to obtain such guarantees and outlines the remedies available to an accused in case of inaction by the ICC and lack of good will of its State parties, including recourse to the European Court of Human Rights.
