This book investigates the reasons why regional integration in East Asia has been much weaker than in other parts of the world. Récemment apparues dans le paysage des juridictions internationales et eu égard au contexte singulier qui est le leur, la mission des juridictions africaines d'intégration d'assurer le respect du droit communautaire doit être évaluée à l'aune des méthodes d'interprétation. L'objet de cet ouvrage consiste à opérer une analyse systématique des méthodes utilisées et à travers elles, à apprécier la contribution des juridictions communautaires aux processus d'intégration africains. L'étude établit une distinction entre les méthodes d'interprétation autonome et les méthodes d'interprétation dérivée. Les premières sont mises au service de la construction des ordres juridiques communautaires, tandis que les secondes sont utilisées en faveur de la légitimation de l'office des juges. Cette distinction est révélatrice d'une politique jurisprudentielle tendant à l'affirmation des ordres juridiques africains tout en reconnaissant la nécessité de s'inspirer du droit comparé pour la réalisation de leur office. Malgré les insuffisances qui affectent l'utilisation de ces méthodes, l'étude permet de conclure que ces cours de justice demeurent des institutions importantes qui participent à la construction des processus d'intégration. Cet ouvrage intéressera non seulement les praticiens du droit africain de l'intégration, en particulier les magistrats qui y trouveront une analyse critique, mais stimulante de leur pratique contentieuse, mais également les étudiants et chercheurs juristes, spécialisés en contentieux et en droit communautaire africain.

This book takes a mixed-methods approach to completely re-evaluate the regional organizations landscape. Based on a systematic categorization of heterogeneous goals, it identifies several regional organizations in various parts of the world (Latin America, Africa, Middle East, Southeast Asia, and post-Soviet Eurasia) to illustrate the most typical cases of how particular types of regional organizations come into existence and evolve. Chapters use a novel large-N dataset of more than sixty regional organizations to establish correlations between members’ goals and their characteristics. Finally, it examines the few cases of formal dissolution of regional organizations in the last fifty years to consider the conditions under which all stakeholders are willing to abandon their support for regional organizations.

Le rôle dévolu aux organisations régionales en matière coercitive est mal défini. Les notions de « coercition » et d’« organisation régionale » sont incertaines, mais aussi les relations de ces organisations régionales avec le système de sécurité collective instauré par la Charte des Nations Unies. Dans cet ouvrage, il est défendu qu’en matière coercitive, les organisations régionales entretiennent avec l’Organisation des Nations Unies (ONU) des rapports régis notamment par le principe de subsidiarité. Si les contours de ce principe ne sont pas clairement définis, il risque cependant d’aboutir à de véritables substitutions des organisations régionales à l’ONU. L’ouvrage réexamine les relations entre l’ONU et les organisations régionales au regard de leur pratique de la coercition. Celle-ci met en lumière l’existence de deux courants au sein du système de sécurité collective qui se complètent et se confrontent. Ainsi, le domaine de la coercition subit-il sa déconcentration et, parallèlement, sa décentralisation. En effet, alors que l’ONU délègue souvent aux organisations régionales l’exécution de la réaction à une menace contre la paix et la sécurité internationales, d’autres fois, les organisations régionales exercent des compétences qui leur sont propres. La déconcentration de la coercition suppose ainsi le maintien d’un seul niveau de compétence et d’une hiérarchie, au sommet de laquelle se trouve l’ONU. La décentralisation implique, pour sa part, l’existence d’une multiplicité de sujets compétents dans le domaine de la coercition dont notamment les organisations régionales.

This book integrates three levels of political–economic analysis: first a comparative institutional analysis of the varieties of capitalism in both Europe and Asia, second a macroeconomic analysis of industrial structural change and economic dynamics of the national economies in Europe and Asia, and then an encompassing analysis of international production linkages and international financial instability which determine the long-term patterns of regional integration in Europe and Asia. The comparison of the European Union and ASEAN delivers some key conditions for a viable long-term regional economic integration to cope with contrasted capitalisms and growth regimes: either pragmatism in the choice of an exchange rate regime, or a form of fiscal federalism. The reader will also find a genuine analysis of the dynamism of the Chinese economy, a study on institutional changes and de-industrialization in Japan, and the increasing international production linkages among China, Japan, Korea, and ASEAN. It is shown how the enlargement of the European Union and the Euro triggered the diverging competitiveness and macroeconomic performances that led to the crisis of a six decades long economic and political process. This book is the result of long lasting Asian–European collaborative research. It is a milestone in the historical and comparative analysis along the régulation theory that aims at understanding the long-run transformations, renewed diversity and interdependence of capitalisms.

The EMU debt crisis that emerged in 2010 has identified a group of Southern countries, especially Greece, Portugal, Spain and Italy, as low performers exhibiting several seriousmacroeconomic imbalances, and it has also highlighted that EU integration experiencedby Eastern European countries (especially the latter-comers to EU) was not accompanied by a rapid process of real convergence.
