The challenge for governments is to find an appropriate balance -- ensuring a sufficient level of protection for its national security interests, while at the same time ensuring that investment protection is still strong enough to keep the country attractive for foreign investors. The review undertaken for this study suggests that up to now, only a minority of IIAs [International investment agreements] contain some kind of national security exception, and that such clauses are more frequent in agreements covering the entry of foreign investment than in treaties limited to the post-establishment phase. IIA Contracting Parties have various options to clarify the scope and conditions under which a national security exception applies. All these options help to prevent the subject of national security exceptions in IIAs from becoming a "black and white" matter, and allow more differentiated solutions to be adopted, permitting a fair balance between the interests of the Contracting Parties and the foreign investors.--Publisher's description

The first two decades of the twenty-first century witnessed a series of large-scale sovereign defaults and debt restructurings, in which sovereigns struggled to negotiate with recalcitrant bondholders, particularly hedge funds. Also, the outbreak of the COVID-19 pandemic in 2020 heralded a bleak financial outlook for many developing and emerging market countries, requiring sovereign debt restructuring in times of great macroeconomic uncertainty. Given the absence of a multilateral mechanism for sovereign debt restructuring equivalent to domestic corporate bankruptcy system, however, defaulted sovereigns often suffer from holdout litigation wrought by bondholders. This book proposes ways in which such legal actions could be regulated without the undue expense of bondholders' remedies by exploring the mechanism of balancing bondholder protection and respect for sovereign debt restructuring at various stages of litigation and arbitration proceedings.

"Amid the ongoing crisis surrounding the WTO, China's role and behaviour in the multilateral trading system has attracted overwhelming attention. This timely monograph provides the first comprehensive and systemic analysis of China's compliance with the rulings of the WTO's dispute settlement mechanism (DSM). It covers all the disputes in which China has been a respondent during its 17-year WTO membership and offers a detailed discussion of China's implementation of adverse WTO rulings, its approaches to settling WTO disputes, the possible explanations for such approaches, and post-compliance issues. The book shows how China has utilised the limitations and flexibilities of WTO rulings to ensure that its implementation of the rulings not only delivers adequate compliance but also maintains its own interests. Overall, this book argues that the issues relating to the quality of China's compliance and post-compliance practices concern the loopholes within the DSM itself which may be utilised by all WTO Members. However, despite the loopholes, China's record of compliance suggests that the DSM has been largely effective in inducing compliance and influencing domestic policy-making. It is therefore in the interest of all WTO Members and other stakeholders to protect the DSM as the 'crown jewel' of the multilateral trading system"--

Il n’existe que très peu de voies de recours en annulation contre les jugements rendus par les juridictions internationales judiciaires et arbitrales. L’acte juridictionnel est réputé définitif et sans appel, ce qui empêcherait que les parties puissent en contester la validité. Sur ce point d’ailleurs, la pratique et la doctrine internationales sont marquées par une tendance très forte qui attache aux jugements une présomption irréfragable de validité en raison de leur caractère définitif. Il est pourtant possible de modifier cette approche et de considérer que l’acte juridictionnel ne peut définitivement trancher un différend que dans la mesure où sa validité n’est pas défectueuse. Le caractère définitif ne préjuge en rien de la validité de l’acte juridictionnel contre lequel une partie peut protester en invoquant des causes de nullité ou, dans une perspective plus procédurale, des motifs d’annulation. Mais il ne suffit pas qu’une partie soulève des motifs d’annulation pour que la nullité du jugement contesté soit acquise. La nullité d’un jugement s’obtient par une procédure juridictionnelle destinée à ce que la validité de l’acte juridictionnel soit renversée à l’égard des deux parties. En l’absence de voies de recours en annulation préétablies et obligatoires, la partie qui cherche à engager une telle procédure devra s’en remettre nécessairement au consentement de l’autre partie. Cet ouvrage innovant est destiné à quiconque s’intéresse au droit international public.

La notion de « dialogue judiciaire » fait l’objet de plusieurs acceptions et de nombreuses critiques. L’ouvrage a pour premier objectif de mieux cerner cette notion sur le triple terrain sémantique, théorique et normatif en étendant le phénomène à toutes les interactions entre juges comme les réseaux de juges, mais aussi les mécanismes institutionnels de droit public et les outils de communication de droit privé. Le droit européen présente deux spécificités en matière de dialogue judiciaire : l’existence de deux juridictions supranationales d’une part et la volonté de mettre en place une véritable coopération judiciaire d’autre part. Chacune de ces deux tendances sont explorées par des spécialistes de droit européen aussi bien du point de vue du droit privé que du droit public. Une question essentielle se pose : quel est le lien entre les dialogues et communications judiciaires dans les champs du droit public et privé européen ? En comparant, les différentes formes d’interactions entre juges en Europe, il apparaît que les dialogues judiciaires – verticaux ou horizontaux, institutionnels ou informels - se rencontrent dans des situations d’internormativité et ont pour effet une intégration juridique substantielle.
