Op 3 april 1990 werd zwangerschapsafbreking uit het Strafwetboek gehaald. De nieuwe abortuswet heeft verregaande gevolgen voor het bio-etisch debat vandaag en is, aldus de mening van de auteurs in dit boek, geenszins waterdicht. 'Abortus na de wet' vlooit de wetteksten uit en benadert de diverse facesten van zwangerschapsafbreking: de vage grenzen tussen de strafbare en de toegelaten vruchtafdrijving, de ongelijke behandeling van de vader die geen inspraak krijgt, de problemen van de ouders met een minderjarige zwangere dochter.

Peine de mort, légitime défense, guerre, objection de conscience, avortement, euthanasie... il ne se passe pas de jour sans que l'une de ces questions n'affleure à la surface des évènements. Vite l'opinion s'inquiète, se passionne. Chacun, au nom de ses convictions, ou de ses impressions, y va de son jugement personnel. Quand la vie et la mort sont en jeu, qui ne se prononcerait? Dans la société française, démocratique et donc pluraliste, la défense de la vie occupe une position variable sur l'échelle des valeurs. Elle paraitra impérative ici quand un agresseur survient, relative là quand un vieillard pèse... L'Etat ne peut rester à l'écart; il intervient, il légifère, il tranche. Au nom de quoi? La loi est peut-être la condition nécessaire de la fraternité. Cependant elle ne concorde pas toujours avec nos convictions intimes de conscience. Inévitable et éprouvante, une tension s'instaure alors entre le droit et la morale, entre la loi de tous et la conscience de chacun. Jusqu'où tolérer cet écart? Et l'Evangile apporte-t-il ici une note spécifique? Sur cet enjeu décisif que représente le pouvoir sur la vie et sur la mort, Jérome Regnier et le Centre interdisciplinaire de l'Institut Catholique de Lille proposent un dossier bien argumenté, qui n'impose pas de réponse péremptoire mais invite chacun à un jugement et une position responsables. Le respect de la personne humaine n'aura jamais fini de déranger individu, société, Etat, de requérir notre lucidité, notre vigilance et notre engagement.
