Can privatizations live up to the expectation of reducing the size of the state? Or will the fears be proven true that privatization can push back on democratic principles and the rule of law? This study tackles four question: What requirements does the constitution lay on the execution of the state tasks? In which respects can the execution of state tasks be privatized? Which problems do the constitutional requirements cause for the privatized execution of tasks? Which room for maneuver does the constitutional requirements leave for the privatized execution? This study does not set out to re-invent the legal phenomenon of privatization or to describe it in a novel way. Rather, this study intends to simplify and to categorize. Privatizations are distinguished fundamentally into whether they concern the task-side or the execution-side of state activity. And it applies the constitutions' requirements in a general way, without delving into the specifics of certain tasks with their special dogmatic categories.

"The Chinese economy is currently undergoing a profound institutional transformation—a quiet revolution. In a regulated environment geared to the requirements of state-owned enterprises, the successs of the private sector as the main focus for economic growth is remarkable. State-owned enterprises are currently being restructured based on market conditions in which private firms are now permitted to play an important role. Fascinated by the implications of this reform within the Chinese economy, the Asia-Pacific School of Economics and Management of The Australian National University, in conjunction with the China Center for Economic Research of Peking University research team, conducted a large sample survey. Four study sites were chosen: Beijing, Chengdu, Shunde and Wenzhou. Leading economists analyse the nature and dynamics of private sector reform within the Chinese economy and make recommendations for policy which support opportunities for growth and investment. Businesses, philanthropies and non-profit entities are increasingly successful in capturing public funds to support private provision of schooling in developed and developing countries. Coupled with market-based reforms that include weak regulation, control over workforces, standardization of processes and economies of scale, private provision of schooling is often seen to be convenient for both public authorities and businesses. This book examines how the public subsidization of these forms of private education affects quality, equality and the realization of human rights.
