Nonostante l’Open Access, vale a dire la disponibilità libera e gratuita dei contenuti in internet, sia ormai un’iniziativa conosciuta, ci sono ancora idee molto confuse e interpretazioni erronee su alcune delle sue caratteristiche e sul suo funzionamento. In quest’opera, Ernest Abadal ha l’obiettivo di chiarire i dubbi e fraintendimenti più frequenti riguardo l’Open Access, presentando le basi teoriche di questo sistema, il ruolo delle riviste scientifiche e l’attitudine dei ricercatori, nonché una stima di quali siano le prospettive future. Questa guida si rivolge tanto agli accademici e ai dirigenti universitari, quanto agli editori e ai professionisti in ambito bibliotecario. L’edizione italiana è stata realizzata con la collaborazione di Maria Teresa Miconi, professoressa di Bibliografia e Biblioteconomia dell’Università di Macerata e riconosciuta esperta di Open Access. La prefazione è a cura di Giovanni Solimine, professore di Biblioteconomia all’Università di Roma La Sapienza, dove è anche presidente del Sistema bibliotecario di Ateneo e direttore della Scuola di Specializzazione in beni archivistici e librari.

The short life of hacker Aaron Swartz, who died by suicide on 11 January 2013, has many incredible aspects. A small computer genius who grew up in a Chicago suburb, he met, as a teenager, scholars of the calibre of Tim Berners-Lee and Lawrence Lessig and worked with them to build the computer architectures, and licences, of the future. In a radical change of life, he will then decide to devote himself to political and technological activism; in the meantime, his talented colleagues are taking advantage of the Silicon Valley wave to get rich. Instead, he will devote his energies, and talent, to fight for open access, secure communications, anonymity, and freeing content and culture from the confines, and paywalls, of big databases. At some point, however, the US government will target him and, slowly, the powerful American judicial machine will crush him. His teaching, his theories, his passion are still today, ten years after his death, an example for many users, hackers and citizens of the information society. La vita troppo breve dell’hacker Aaron Swartz – morto suicida l’11 gennaio del 2013 – ha tantissimi aspetti incredibili. Piccolo genio dell’informatica cresciuto in un sobborgo di Chicago, incontra, da adolescente, studiosi del calibro di Tim Berners-Lee e Lawrence Lessig e lavora con loro per costruire le architetture informatiche, e le licenze d’uso, del futuro. Con un cambio di vita radicale, deciderà poi di dedicarsi all'attivismo politico e tecnologico proprio mentre i suoi coetanei più talentuosi sfruttano l’onda della Silicon Valley per arricchirsi. Lui dedicherà, invece, le sue energie e il suo talento a combattere per l’open access, per la sicurezza delle comunicazioni, per l’anonimato e per “liberare” contenuti e cultura dai confini, e pedaggi, delle grandi banche dati. A un certo punto, però, il governo degli Stati Uniti d’America lo prenderà di mira e, lentamente, la potente macchina giudiziaria americana lo stritolerà. Il suo insegnamento, le sue teorie, la sua passione sono ancora oggi, a distanza di dieci anni dalla sua morte, esempio per tantissimi utenti, hacker e cittadini della società dell’informazione.

Questo libro ci presenta una visione d’insieme sul mondo dell’openness, dal software open source ai servizi cloud, passando per le licenze Creative Commons e gli open data. Tra i primi ad averne fatto l’oggetto principale della propria attività scientifica e professionale, per la prima volta nel panorama italiano l’autore ci offre un quadro sistematico di come realizzare l’apertura e la condivisione di beni intellettuali che altrimenti rimarrebbero riservati. Un fenomeno che, da marginale, è divenuto centrale in vari contesti. L’opera si presenta al lettore in modo chiaro ma non banale. L’autore affronta temi complessi con stile lineare e comprensibile anche ai digiuni di diritto, ma conservando un necessario rigore scientifico, fornendo gli elementi per una teoria generale per la creazione e la promozione di beni intellettuali comuni, o commons. Un approccio rivoluzionario a questa branca del diritto, che capovolge l’uso di strumenti ben noti come il copyright e le licenze, richiedeva l’intervento di un giurista fuori dagli schemi e anticonformista come Piana.

Die Frage nach dem Umgang mit »treuhänderisch« verwahrtem Kulturgut bzw. Raubgut betrifft Bibliotheken, Archive und Museen sowie jüdische Institutionen. Während die gängigen Erwerbungsarten in Kultureinrichtungen wie Kauf, Geschenk, Pflicht und Tausch übliche Geschäftsvorgänge darstellen und im Rahmen der NS-Provenienzforschung kritisch untersucht werden, sind mit Auflagen versehene Übernahmen und Verwahrungen wie Treuhand, Leihgaben oder Legate, aber auch staatliche Zuweisungen im Kontext von NS-Kulturgutraub und staatlichen Transformationsprozessen bislang wenig beachtet worden. Neben der Darstellung der bisherigen Handhabung »treuhänderisch« übernommener Kulturgüter werden hier strukturierte Vorgehensweisen sowie die Anforderungen, Chancen und Grenzen eines adäquaten Umgangs interdisziplinär erörtert.

"What can and can't be copied is a matter of law, but also of aesthetics, culture, and economics. The act of copying, and the creation and transaction of rights relating to it, evokes fundamental notions of communication and censorship, of authorship and ownershipâof privilege and property. This volume conceives a new history of copyright law that has its roots in a wide range of norms and practices. The essays reach back to the very material world of craftsmanship and mechanical inventions of Renaissance Italy where, in 1469, the German master printer Johannes of Speyer obtained a five-year exclusive privilege to print in Venice and its dominions. Along the intellectual journey that follows, we encounter John Milton who, in 1644 accused the English parliament of having been deceived by the 'fraud of some old patentees and monopolizers in the trade of bookselling' (i.e. the London Stationers' Company). Later revisionary essays investigate the regulation of the printing press in the North American colonies as a provincial and somewhat crude version of European precedents, and how, in the revolutionary France of 1789, the subtle balance that the royal decrees had established between the interests of the author, the bookseller, and the public, was shattered by the abolition of the privilege system. Biographical note: Jöran Muuß-Merholz ist Diplom-Pädagoge mit einem Schwerpunkt auf Lernen und Lehren im digitalen Wandel. Er gilt als Experte und Wegbereiter für die Arbeit mit digitalen Materialien, insbesondere mit Open Educational Resources (OER). Long description: Lehrkräfte betätigen sich täglich als Remixkünstler_innen. Für guten Unterricht kombinieren sie Materialien aus verschiedenen Quellen, sodass sie auf die jeweilige Lernsituation, das jeweilige Lernbedürfnis zugeschnitten sind.
