Issues that touch on the separation of powers, that is, on the relationship between parliament, government and the judiciary, and on the relationship between the Public Prosecution Service, the legal profession and the judge, have been rife in the news of the past twenty years ( for example IRT affair, acquittal of terror suspects, trial Wilders). The separation of powers is part of most Dutch definitions of the rule of law. The research resulting from this WODC publication is aimed at identifying trends and patterns in messages (from newspapers, television news bulletins, news websites, Twitter) over the past twenty years that could affect confidence in the rule of law. It was examined whether text mining, that is, automated text analysis or "content analysis", is an appropriate research tool.

The public sector in our society has over the past two decades undergone substantial changes, as has the academic field studying Public Administration (PA). In the next twenty years major shifts are further expected to occur in the way futures are anticipated and different cultures are integrated. This volume carries out a study with the aim to assess any flaw in the care, hospital and local services in the event of disasters with medium to long-term implications. The method features a set of indicators applied to three parameters (suitability, efficiency and quality of the health services). The project’s aim is to identify the vulnerability of the hospitals in Florence in the event that the area of the Municipality and its surroundings are affected by a major emergency, with partial or complete damage to the continuity of care in hospitals. Furthermore, strategies and plans are proposed to maintain business continuity even in the event of such an emergency.

In 1865, there was the enactment of the laws of administrative unification for the Kingdom of Italy. On the occasion of the 150th anniversary, the Department of Legal Sciences of the University of Florence organized a study project on the transformations which over the last fifty years have affected the Italian Republic's administrative apparatus and activities. They analysed in its articulated local government and its EU membership. Over nearly two years, the researches have involved more than one hundred and fifty scholars from Italian universities. The results were presented on 15th and 16th October 2015 in Florence, the Italian capital city a hundred and fifty years before, which in 1965 had hosted the conference celebrating the 100th anniversary of the same administrative unification laws. In den letzen Jahren rückten vielfältige Gender Budgeting-Initiativen in den öffentlichen Fokus, die das Ziel hatten, die Gleichstellung von Frauen und Männern zu fördern. Ihnen wird ein großes emanzipatorisches und demokratisches Potential zugeschrieben. Während der Demokratisierungsanspruch zwar häufig betont wird, stellen die Definition und Präzisierung von Demokratie bzw. Demokratisierung bislang weitgehend unbehandelte Bereiche dar. Daher zielt die Arbeit darauf ab, die theoretische Fundierung von Gender Budgeting zu vertiefen und damit einen Beitrag zu einer geschlechtergerechten und emanzipatorischen Demokratisierung der Finanzpolitik zu leisten. Mit Hilfe einer Qualitativen Inhaltsanalyse wird eine Untersuchung feministisch-demokratietheoretischer Überlegungen vorgenommen, um daraus einen Kriterienkatalog zu entwickeln. Dieser wird anschließend in den Budgetprozess integriert, um ein Modell eines feministisch-demokratischen Budgetprozesses beispielhaft anhand des Wiener Budgetkreislaufes zu entwerfen.

Cet ouvrage étudie la fiscalité douanière de la province romaine d'Égypte selon une approche centrée sur les pratiques du contrôle douanier dans les différentes circonscriptions administratives de la province. Fondée sur un corpus documentaire se constituant principalement de papyrus et ostraca en langue grecque et, dans une moindre mesure, d'inscriptions lapidaires, l'enquête est structurée en trois parties. La première, intitulée 'Les pratiques du contrôle douanier: une approche documentaire' s'intéresse au vocabulaire fiscal, notamment aux appellations des impôts douaniers et des postes et bureaux douaniers relevés, en tâchant de préciser leurs caractéristiques géographiques et administratives. Elle traite dans un deuxième temps des différentes typologies des écrits douaniers conservés en étudiant dans le détail les formulaires aussi bien que leurs fonctions spécifiques dans les contrôles douaniers. Elle aborde dans un troisième temps les formes d'authentification des documents produits par les personnels douaniers. La deuxième partie, intitulée 'Personnels douaniers et production documentaire' s'intéresse plus particulièrement aux acteurs qui intervenaient dans la production et dans la validation des documents douaniers conservés. Les résultats de cette enquête permettent ensuite d'esquisser les grandes lignes d'une hiérarchie des personnels douaniers, selon les différentes régions concernées, puis de préciser pour chacune d'entre elles les milieux sociaux et ethniques de recrutement. La troisième partie de l'ouvrage est consacrée aux formes de 'supervision publique des contrôles douaniers'. Il est ici ainsi question d'examiner les différents contrôles mis en oeuvre par les autorités publiques dans le champ des écritures fiscales et des transactions financières et les personnels qui y étaient préposés. Sont ensuite étudiés les contrôles policiers réalisés au moyen de corps de garde plus ou moins spécialisés selon les régions et les époques, ainsi que la part jouée par le corps de garde fluviale dans ce contexte. Ces éléments ont permis enfin de proposer une reconstitution du maillage territorial des contrôles douaniers, dont sont dégagées les pratiques écrites et factuelles.

La crise sanitaire que nous traversons, sans doute encore davantage que les autres crises sanitaires avant elle, au-delà des adaptations en droit qu'elle a imposées, a mis et met encore à l'épreuve ce que le droit prévoit en matière de contrôle de la décision publique. Elle en souligne les potentialités mais aussi les limites et invite, peut-être, à repenser les mécanismes qui le caractérisent ou les concepts qui le sous-tendent. Il s'agira ainsi de tirer les leçons de la crise sanitaire en envisageant, en droit, la question de la responsabilité et le contrôle de la décision publique (son objet comme ses modalités) par les citoyens et tous ceux qui s'expriment en leur nom, qu'il s'agisse des parlements ou de la justice.

El libro es una adaptación de una investigación presentada a la Universidad Nacional San Antonio Abad del Cusco, cuyo objetivo fue establecer si el incumplimiento efectivo del plazo razonable en la calificación de denuncias de parte en el Ministerio Público peruano, vulnera el Principio constitucional de la Tutela Procesal Efectiva. Se ha evidenciado que la tutela jurisdiccional efectiva tiene como finalidad que los justiciables sigan un proceso penal rápido en ambos niveles, función que es incumplida de acuerdo con el Código Procesal Penal, lo que vulnera este principio o derecho constitucional. Se identificó entonces que la tutela jurisdiccional efectiva, a través del plazo razonable, se muestra como un vacío legal en el Código Procesal Penal, mediante el cual se deba fijar cual es el plazo legal que debe tener el Ministerio Público para emitir su disposición fiscal al momento de resolver una denuncia de parte presentada por el agraviado o víctima. Se concluye entonces que, establecido el plazo legal que debería tener el Ministerio Público para emitir su disposición ante una denuncia de parte, debería insertarse en el artículo 329° del Código Procesal Penal un inciso más, a fin de establecer de manera expresa cual es el plazo legal máximo que tendría el Ministerio Público para calificar la denuncia de parte presentada por el agraviado o víctima.
