Sport is an integral part of British culture and an important aspect of modern life. Although its importance has been recognised by academic historians, sport has yet to be fully appreciated in the growing and related fields of heritage and museum studies. Sport and heritage have operated as seemingly separate spheres, yet together they can convey powerful messages; convergence between them is seen in the rise and popularity of sports museums, the collecting of sporting art and memorabilia, and popular concern over the demise of historic sports buildings and sport-related sites. These places, exhibitions and activities help to shape our understanding of sport, history and the past. The essays in this volume explore sports history as manifested in academic enquiry, museum exhibitions and heritage sites. Concilier indépendance et solidarité entre époux au travers du contrat de mariage. La loi du 22 juillet 2018 a inséré dans l’ancien Code civil de nouvelles dispositions relatives à la séparation des biens avec clause de participation aux acquêts, permettant aux futurs époux qui souhaitent adopter ce régime de simplement s’y référer. Jusqu’alors, en effet, pour opter pour ce type de régime matrimonial, il fallait le décrire précisément dans un contrat de mariage. Est-il alors nécessaire de proposer un modèle pour un tel contrat ? Les auteurs du présent ouvrage en demeurent convaincus, d’une part, en raison du fait que les dispositions légales soit sont imparfaites, soit peuvent ne pas correspondre à ce que les futurs époux désirent ; d’autre part, au motif que le régime de la séparation des biens avec clause de participation aux acquêts conserve – à tort selon les auteurs – la réputation d’être compliqué dans sa rédaction, sa compréhension par le praticien ou les citoyens voire sa liquidation : c’est donc en le rédigeant et en le détaillant correctement que l’on pourra le mieux le comprendre et l’expliquer obligatoirement aux futurs époux. Le présent modèle (y compris les variantes qui le composent) est basé sur celui de la séparation des biens pure et simple (qui demeure le fondement de la participation aux acquêts), amendé au regard de la participation aux acquêts qui caractérise ce régime. Lorsque celui prévu dans la loi leur paraissait inopportun ou imparfait, les auteurs ont opté pour d’autres formules – parfois inspirées de premiers modèles antérieurs à la loi du 22 juillet 2018 – permettant de mieux atteindre l’objectif d’indépendance patrimoniale des époux alliée à une certaine solidarité entre eux.
