"This book provides detailed critical analysis of the jurisprudence of the European Court of Human Rights on domestic abuse. Such abuse affects vast numbers of people throughout all nations of the world. Although it was not until 2007 that domestic abuse was considered substantively by the European Court of Human Rights, it has now been established that such abuse can constitute a violation of the right to life under Article 2 of the European Convention on Human Rights; the right to be free from torture or inhuman or degrading treatment under Article 3; the right to respect for private and family life under Article 8; and the prohibition of discrimination under Article 14. The book analyses how conceptualisations of domestic abuse in the Court's jurisprudence have evolved, for example, in relation to a more consistent use of Article 3 in such cases, a recognition of coercive control, and the framing of domestic abuse as gender-based discrimination. It also explores the development of the Court's understanding of domestic abuse, for example as regards to how the 'Osman test' should be applied in this context. Additionally, the work discusses the Court's approach to issues such as cyber violence, and child contact in the context of domestic abuse. The volume will appeal to academics and researchers from a wide variety of disciplines, such as criminal law, criminology, social policy, human rights, family law, gender studies and sociology; as well as practitioners and those in the voluntary sector who are working in the area of combating domestic abuse. Cette thèse fribourgeoise offre une vue d’ensemble sur la notion de « sexisme » et son appréhension par le droit. En analysant, d’une part, comment le droit est imprégné de biais sexistes et en déterminant, d’autre part, comment il pourrait être amélioré pour la lutte contre le sexisme, l’auteure propose une approche féministe du droit contre le sexisme. Une approche féministe du droit international et européen, d’abord, qui veille à ce que les droits des femmes et la façon dont ils sont interprétés par les organes judiciaires internationaux, ou par d’autres ordres juridiques, soient compris en référence à leurs fondements féministes. Une approche féministe du droit suisse, ensuite, qui permette aux institutions qui créent, appliquent, interprètent le droit en Suisse de contribuer effectivement à la lutte contre le sexisme.

Domestic Abuse and Human Rights' presents an overview of the relevance of the European Convention on Human Rights to domestic abuse. It has three aims: first, to consider the relevant case law and application of the key articles to questions around domestic abuse; second, to consider at a theoretical level the balance between protection and autonomy at the heart of the legal response to domestic abuse; third, to propose practical application of a human rights approach to issues around domestic abuse, with particular emphasis placed on the significance of the Istanbul Convention on Preventing and Combatting Violence against Women.0The book argues that a human rights approach requires states to take a proactive stance towards domestic abuse. It should no longer be regarded as a private matter, but as a human rights approach mandating state intervention, although within limits. So understood the European Convention on Human Rights provides a powerful impetus for states to ensure an effective response to the major problem of domestic abuse.
