Abstract

Since 2009 two courts have been shaping human rights of asylum seekers in Europe: the Court of Justice of the EU (CJEU) and the European Court of Human Rights (ECtHR). Side by side, the courts examined who is protected from refoulement, when and how asylum seekers can be detained and what remedies they should have access to. Did they seek convergence in their asylum case-law or paid no attention to each other’s jurisprudence? Did they establish a coherent standard of the asylum seekers’ protection in Europe? Judicial dialogue between the ECtHR and CJEU in the area of asylum is at the heart of this study. The book offers also a comprehensive overview of the asylum case-law of the two courts and identifies the main convergences and divergences in their approach to protection against refoulement, immigration detention and effective remedies.

Abstract

Les textes de base sont enrichis de notes historiques, de renvois et de références de jurisprudence, ce qui fait de ce Code un outil indispensable pour une approche plus approfondie de la matière. Nous avons par ailleurs cherché à préserver la précision des textes en ajoutant les réglementations régionales, les conventions internationales, les lois particulières, les dispositions transitoires et les arrêtés royaux habituellement joints au Code civil. Le Livre 2, Titre 3 (entré en vigueur le 1er juillet 2022), le Livre 3 (1er septembre 2021), le Livre 4 (1er juillet 2022) et le Livre 8 (1er novembre 2020) figurent dans le Code de même que les Livres 1 et 5 (dont l’entrée en vigueur est fixée au 1er janvier 2023). L’intégration du droit futur et des variantes régionales rend la lecture du Code civil de plus en plus malaisée, mais il s’agit, nous semble-t-il, du prix à payer pour une appréhension complète de la matière. Abstract

This volume contains the general report and the national reports on the subject “Precedent and the Law”, which were submitted to the world congress of the International Academy of Comparative Law held in Utrecht in 2006. Precedent is often considered a major distinction mark between the civil law and the common law. But is this still the case ? In common law jurisdictions the sharp edges of “stare decisis” seem to water down, whereas civil law jurisdictions now do admit that precedents - at least de facto - constitute a source of law. Convergence, however, would be too strong a word to characterise these tendencies. These reports throw light on this issue.

Abstract

This short monograph attempts an exploration of the legal treatment of evidence questions in Cyprus law. The first section of the study offers a comparative-law introduction to the legal system of Cyprus – a mixed legal system that in matters of civil litigation, including evidence, tends to strongly follow the English common law tradition (including the existence of an autonomous legal field of evidence law, that tends to be dominated by criminal evidence law. The second section presents the general principles underlying Cypriot civil procedure, including evidence. The sections that follow examine in more detail legal aspects involving civil evidence, especially how the basic types of evidence are treated in Cyprus law and how the processes for the taking of evidence are organized. The study also examines special questions including the legal treatment of illegally obtained evidence, legal costs and problems of language. The final section examines the cross-border dimensions of civil evidence-taking.
