Ce travail traite principalement de la notion de dommage dans le cadre de l'action en wrongful life. Cette question a suscité de vifs débats à travers le monde, mêlant à fois des considérations juridiques et éthiques.
L'objectif de cet exposé sera d'analyser les divers points de vue doctrinaux mais aussi jurisprudentiels ; d'une part, sous un angle du droit belge et d'autre part, sous un angle du droit comparé. Afin de pallier à l'absence de reconnaissance de l'action lorsque le dommage est analysé selon la théorie de la différence négative, une attention particulière sera adressée à la possibilité de lui substituer des concepts alternatifs du dommage.
Enfin, nous envisagerons la potentialité d'un avenir pour cette action en wrongful life.
