Abstract

The 1909 Companies Act was known as the “Transvaal Act”. After South Africa was established as a Union, each province had its own Companies Act. There is no indication that the 1909 Act was amended on provincial level. Later on, a new Act was written, namely the “1926 Companies Act”, and it was based upon the 1909 Act. Most South African textbooks cite only the 1926 and 1973 Companies Act, without any reference to the 1909 Act. This historic legislation is however relevant to fully understand the background to South African company law. Furthermore, the 1909 Act contains more than 26 definitions, such as: a special resolution, private company, debenture, director, share and prospectus. Most of these concepts are still relevant today, 110 years later.

Abstract

This book empirically investigates the social practice of ascribing moral responsibility to others for the things they failed to do, and it discusses the philosophical relevance of this practice. In our everyday life, we often blame others for things they failed to do. For instance, we might blame our neighbour for not watering our plants during our vacation. Interestingly, the attribution of blame is typically accompanied by the attribution of causal responsibility. We do not only blame our neighbour for not watering our plants, but we do so because we believe that not watering the plants caused them to dry up and die. In this book, I investigate how we make moral and causal judgments about omissions. I discuss different philosophical perspectives on this matter, and I outline to what extent the actual social practice is in line with philosophical theories.

Abstract

"Trasmundi combines her background as a cognitive ethnographer with theory of radical embodied cognition and interaction to investigate how healthcare practitioners manage cognitive events in patient treatment and diagnosing that often lead to human errors. This interdisciplinary focus emphasises how professional action underlines various forms of cognitive and social life that involves language, tools, organisational procedures, shared expertise, cultural values and social rules. The book investigates such phenomena which previously have fallen in the gaps between established disciplines of interaction analysis and psychology. In arguing that the multi-scalar constraints of professional action are still underexplored in a naturalistic setting of emergency medicine, Trasmundi uses tools such as multimodal interaction analysis and cognitive event analysis to investigate the cultural and distributed nature of cognition. The book provides the reader with a new take on this heavily investigated topic, both theoretically and methodologically by describing how medical culture affects real-time interaction and how culture itself is shaped by the exact same dynamics"--

Abstract

This groundbreaking work, with its unique anthropological approach, sheds new light on a central conundrum surrounding AIDS in Africa. Robert J. Thornton explores why HIV prevalence fell during the 1990's in Uganda despite that country's having one of Africa's highest fertility rates, while during the same period HIV prevalence rose in South Africa, the country with Africa's lowest fertility rate. Thornton finds that culturally and socially determined differences in the structure of sexual networks-rather than changes in individual behavior-were responsible for these radical differences in HIV prevalence. Incorporating such factors as property, mobility, social status, and political authority into our understanding of AIDS transmission, Thornton's analysis also suggests new avenues for fighting the disease worldwide.
