Abstract

This book studies major works of literature from classical antiquity to the present that reflect crises in the evolution of Western law: the move from a prelegal to a legal society in The Eumenides, the Christianization of Germanic law in Njal's Saga, the disenchantment with medieval customary law in Reynard the Fox, the reception of Roman law in a variety of Renaissance texts, the conflict between law and equity in Antigone and The Merchant of Venice, the eighteenth-century codification controversy in the works of Kleist, the modern debate between "pure" and "free" law in Kafka's The Trial and other fin-de-siècle works, and the effects of totalitarianism, the theory of universal guilt, and anarchism in the twentieth century. Using principles from the anthropological theory of legal evolution, the book locates the works in their legal contexts and traces through them the gradual dissociation over the centuries of law and morality. It thereby associates and illuminates these masterpieces from an original point of view and contributes a new dimension to the study of literature and law. In contrast to prevailing adherents of Law-and-Literature, this book professes Literature-and-Law, in which the emphasis is historical rather than theoretical, substantive rather than rhetorical, and literary rather than legal. Instead of adducing the literary work to illustrate debates about modern law, this book consults the history of law as an essential aid to the understanding of the literary text and its conflicts.

Abstract

The emergence of an interdisciplinary study of law and literature is one of the most exciting theoretical developments taking place in North America and Britain. In Law and Literature: Possibilities and Perspectives Ian Ward explores the educative ambitions of the law and literature movement, and its already established critical, ethical and political potential. He reveals the law in literature, and the literature of law, in key areas of literature, from Shakespeare to Beatrix Potter to Umberto Eco, and from feminist literature to children's literature to the modern novel, drawing out the interaction between rape law and The Handmaid's Tale, and the psychology of English property law and The Tale of Peter Rabbit. This original book defines the developing state of law and literature studies, and demonstrates how the theory of law and literature can illuminate the literary text.

Abstract

The family, Cynthia Patterson demonstrates, played a key role in the political changes that mark the history of ancient Greece. From the archaic society portrayed in Homer and Hesiod to the Hellenistic age, the private world of the family and household was integral with and essential to the civic realm. Early Greek society was rooted not in clans but in individual households, and a man's or woman's place in the larger community was determined by relationships within those households. The development of the city-state did not result in loss of the family's power and authority, Patterson argues; rather, the protection of household relationships was an important element of early public law. The interaction of civic and family concerns in classical Athens is neatly articulated by the examples of marriage and adultery laws. In law courts and in theater performances, violation of marital relationships was presented as a public danger, the adulterer as a sexual thief. This is an understanding that fits the Athenian concept of the city as the highest form of family. The suppression of the cities with the ascendancy of Alexander's empire led to a new resolution of the relationship between public and private authority: the concept of a community of households, which is clearly exemplified in Menander's plays. Undercutting common interpretations of Greek experience as evolving from clan to patriarchal state, Patterson's insightful analysis sheds new light on the role of men and women in Greek culture.
