La mondialisation a multiplié les raisons de s’initier aux normes internationales du travail puisque l’ouverture des frontières appelle une régulation transnationale. Cet ouvrage permet de connaître spécialement, mais pas seulement, celles élaborées par l’OIT (Organisation internationale du Travail) et l’étendue des obligations des États, en particulier lorsqu’ils les ratifient.D’autres motifs poussent à examiner ces dispositions, même en l’absence d’une ratification : un législateur pour ses lois, un gouvernement pour son programme social, une entreprise pour sa politique du personnel, des associations patronales ou syndicales pour leurs négociations collectives, voire, comme cela arrive, un juge pour ses décisions, puisent une inspiration dans les conventions et les recommandations internationales du travail. Leur intérêt dépasse, par conséquent, et de beaucoup, leur force juridique propre.Les normes internationales du travail se révèlent enfin des guides précieux pour les enseignants, les chercheurs et les étudiants, en droit comparé. À partir du moment, en effet, où la confrontation des documents juridiques couvre plusieurs pays, que surtout elle s’étend au-delà d’un groupe homogène d’entre eux, ces normes constituent à la fois d’utiles instruments d’analyse et des repères de qualité pour identifier des communs dénominateurs ; elles permettent même de mesurer le degré de conformité de dispositions juridiques données avec les principes généralement admis qu’elles contiennent.

This open access book explores the role of the ILO (International Labour Organization) in building global social governance from multiple and mutually complementary perspectives. It explores the impact of this UN´s oldest agency, founded in 1919, on the transforming world of work in a global setting, providing insights into the unique history and functions of the ILO as an organization and the evolution of workers’ rights through international labour standards stemming from its regulatory mechanism. The book examines the persistent dilemma of balancing the benefits of globalization with the protection of workers. It critically assesses the challenges that emerge when international labour standards are implemented and enforced in highly diverse regulatory frameworks in international, regional, national and local contexts. The book also identifies feasible ways to achieve more inclusive labour protection, putting into perspective the tension between the economic and the social in the ILO’s second century of operation. It includes reflections on the work of the ILO World Commission on the Social Dimension of Globalisation by Tarja Halonen, who as President of Finland co-chaired the Commission with Benjamin William Mkapa, President of Tanzania. Written by distinguished experts and scholars in the fields of international labour law and international law, the book provides an insightful and in-depth analysis of the role of the ILO as an international organization devoted to decent work and social justice. It also sheds light on tripartism and its particular role in the work of the ILO, examining the challenges that a profoundly changing working life presents in terms of labour protection and social justice, and examining the transnational dimension of labour law. Lastly, the book includes a postscript by Nobel economics laureate Professor Joseph E. Stiglitz.

Un coup de projecteur sur un organe indispensable. Le centenaire de l’Organisation internationale du Travail, célébré durant l’année 2019, a rappelé que les normes internationales du travail constituent des outils de premier plan pour le développement des politiques nationales en matière sociale. Le droit international du travail est en outre une source précieuse pour les juges et juristes nationaux dans la résolution des litiges en matière de droit du travail. Les tribunaux s’inspirent ainsi de plus en plus – à des degrés divers selon les pays – des normes internationales du travail et de leur interprétation par les organes de contrôle de l’OIT. Pourtant, cette organisation souffre d’un manque réel de visibilité et reste encore trop souvent méconnue du grand public, voire des praticiens du droit social. Le présent ouvrage est tout entier dédié à l’étude des normes produites par l’OIT, qui constituent l’essentiel de la réglementation internationale du travail. Après un nécessaire détour historique, l’auteur analyse ce qui fait encore aujourd’hui l’originalité de l’OIT dans le paysage des organisations internationales, à savoir : son cadre institutionnel, qui tend à associer sur un pied d’égalité les gouvernements et les partenaires sociaux, sa procédure d’élaboration et d’adoption des normes internationales, réelle révolution pour le droit international, son mécanisme de contrôle du respect par les États parties de leurs engagements internationaux. Il propose ensuite un aperçu des instruments adoptés par l’OIT avant de s’intéresser au rôle actif que devrait jouer le juge national en matière de promotion des normes de l’OIT dans le règlement des différends portés devant lui. L’ouvrage fournit ainsi les clés de compréhension de cette organisation avant-gardiste dans le paysage international et donne un aperçu de son œuvre normative féconde. Il vise aussi et surtout à sensibiliser le lecteur – qu’il soit étudiant, syndicaliste, avocat, magistrat, académique, etc. – à l’importance du rôle joué par l’OIT dans la promotion d’une paix universelle basée sur la justice sociale et à sa contribution au développement d’un programme centré sur l’humain, nécessaire pour un avenir du travail décent.
