With the adoption of the United Nations Convention on the Rights of the Child (1989), commentators began to situate the evolution of the status of children within the context of the "property to persons" trajectory that other human rights stories had followed. In the first edition of A Question of Commitment, editors R. Brian Howe and Katherine Covell provided a template of analysis for understanding this evolution. They identified three overlapping stages of development as children transitioned from being regarded as objects to subjects in their own right: social laissez-faire, paternalistic protection, and children's rights. In the social laissez-faire stage, children are regarded as objects, and largely as the property of parents. In the paternalistic protection stage, children are seen as vulnerable and in need of protection. The children's rights stage lays emphasis on children as rights-bearers, as individuals in their own right with entitlements. In this second edition, new essays assess the extent to which children's rights have been incorporated into their respective areas of policy and law. The authors draw conclusions about what the situation reveals about the status of children in Canada. Overall, many challenges remain on the pathway to full recognition and citizenship.

The universal feeling that discrimination and intolerance based on race. religion or beliefs have to be confronted by the international community led to the adoption, half a century ago, of the international convention to which this book is devoted, one of the most ratified treaties. The book comments on the contents of the Convention and its impact on anti-racist and anti-bias legislation and jurisprudence, as well as its influence on, and applicability to other international texts. In an Introduction to this reprint, the author updates the status of the Convention, summarizes the work of CERD, the implementation body of the Convention, and discusses its relevance to general human rights, particularly the area of religious intolerance, and some difficult issues such as the possible clash with other fundamental freedoms.

This is the very first edited collection on International Convention on the Elimination of All Forms of Racial Discrimination (ICERD), the oldest of the UN international human rights treaties. It draws together a range of commentators including current or former members of the Committee on the Elimination of Racial Discrimination (CERD), along with academic and other experts, to discuss the meaning and relevance of the treaty on its fiftieth anniversary. The contributions examine the shift from a narrow understanding of racial discrimination in the 1960s, premised on countering colonialism and apartheid, to a wider meaning today drawing in a range of groups such as minorities, indigenous peoples, caste groups, and Afro-descendants. In its unique combination of CERD and expert analysis, the collection acts as an essential guide to the international understanding of racial discrimination and the pathway towards its elimination.

Many have praised the United Nations Convention on the Rights of Persons with Disabilities (CRPD), first adopted by the UN in 2006, as a revolutionary step towards disability rights in Africa. But how real is the progress towards equality for persons with physical disabilities, mental health difficulties, blindness, deafness or albinism? What are the barriers to the CRPD's successful implementation on the continent, and how might we enforce inclusiveness and equality among those disadvantaged? This book brings together the findings of researchers in Ghana, Cameroon, Nigeria, Ethiopia, Uganda, Kenya, Zimbabwe and South Africa to offer grassroots' perspectives on the challenges and possibilities of achieving disability rights under the CRPD. Challenging the generally optimistic view presented to date, the contributors provide evidence-based trenchant critiques of the Convention, highlight the ways in which disability rights are interpreted in varying contexts and with different disabilities, and examine particular issues in relation to children and women. Finally, the contributors suggest ways of moving forward and achieving disability rights in Africa.

The UN Convention on Migrant Workers' Rights is the most comprehensive international treaty in the field of migration and human rights. Adopted in 1990 and entered into force in 2003, it sets a standard in terms of access to human rights for migrants. However, it suffers from a marked indifference: only forty states have ratified it and no major immigration country has done so. This highlights how migrants remain forgotten in terms of access to rights. Even though their labour is essential in the world economy, the non-economic aspect of migration - and especially migrants' rights - remain a neglected dimension of globalisation. This volume provides in-depth information on the Convention and on the reasons behind states' reluctance towards its ratification. It brings together researchers, international civil servants and NGO members and relies upon an interdisciplinary perspective that includes not only law, but also sociology and political science.
