Veel uitbaters van internetpagina’s denken dat het internet een virtuele ruimte is, die niet onder de gelding van een (inter)nationaal recht valt. Niets is minder waar. Het internet wijzigt niets aan de fundamentele rechten van iedere natuurlijke persoon. Deze bijdrage geeft een algemeen overzicht van de beginselen inzake de verwerking van persoonsgegevens. Met dit boek beschikt de jurist over een praktisch instrument voor het opzoeken van de wetgeving over de gegevensverwerking op het internet.

One of the most challenging issues facing our current information society is the accelerating accumulation of data trails in transactional and communication systems, which may be used not only to profile the behaviour of individuals for commercial, marketing and law enforcement purposes, but also to locate and follow things and actions. Data mining, convergence, interoperability, ever increasing computer capacities and the extreme miniaturisation of the hardware are all elements which contribute to a major contemporary challenge: the profiled world. This interdisciplinary volume offers twenty contributions that delve deeper into some of the complex but urgent questions that this profiled world addresses to data protection and privacy. The chapters of this volume were all presented at the second Conference on Privacy and Data Protection (CPDP2009) held in Brussels in January 2009 (www.cpdpconferences.org). The yearly CPDP conferences aim to become Europe's most important meeting where academics, practitioners, policy-makers and activists come together to exchange ideas and discuss emerging issues in information technology, privacy and data protection and law. This volume reflects the richness of the conference, containing chapters by leading lawyers, policymakers, computer expets, technology assessment practitioners and social scientists. The chapters cover generic themes such as the evolution of a new generation of data protection laws and the constitutionalisation of data protection and more specific issues like security breaches, unsolicited adjustments, social networks, surveillance and electronic voting. Dit essentieel wetboek wil diverse doelstellingen realiseren. In de eerste plaats richten we ons op de studenten rechten, criminologie, sociologie en/of politieke wetenschappen die vooral aan de Universiteit Gent en de Vrije Universiteit Brussel een opleidingsonderdeel ‘bewakings- en beveiligingsmanagement’ of ‘private politiestudies’ in hun curriculum moeten of kunnen opnemen. Dit wetboek onontbeerlijk voor die studenten die hun bachelor- en/of masterproef maken, dan wel stage doen in deze criminologische setting. Daarnaast zijn er de praktijkstudenten die in het kader van hun effectieve tewerkstelling in de private veiligheidszorg (bij)scholing en opleiding nodig hebben om aan de wettelijke verplichtingen te voldoen. Het is voor hen tevens een instrument van permanente vorming. Inhoudelijk is dit wetboek nu opgedeeld in vier grote aandachtsgebieden. de rechten en vrijheden, ^ de relevante strafrechtelijke bepalingen, de private veiligheidszorg en enkele diverse bepalingen. Vooral met betrekking tot de private veiligheidszorg is ervoor geopteerd, gezien de complexiteit van de wetgeving dito uitvoeringsbesluiten, te werken met trefwoorden. Het spreekt voor zich dat de private veiligheidszorg slechts kan gedijen en welvaart genereren indien ze blijvend oog heeft voor de fundamentele rechten en vrijheden van ieder individu. De teksten in deze codex zijn bijgewerkt tot BS 1 oktober 2019.

S'il apparaissait, voici quelques années encore, comme l'apanage d'une poignée de spécialistes, le droit de la vie privée ne peut plus laisser aucun juriste, ni plus largement aucun citoyen, indifférent. Il s'est immiscé dans toutes les sphères du droit et présente aujourd'hui un caractère incontestablement transversal et transfrontalier. Le développement des technologies de transfert et de traitement des données, dont l'internationalisation et l'utilisation sur les lieux de travail sont croissantes, comme celui des technologies permettant l'identification des personnes et des biens (par radiofréquence: technologie "RFID" ou par des systèmes biométriques basés sur l'aspect physique ou le comportement des personnes) suscitent légitimement l'interrogation, voire la crainte. L'Unité de droit économique (Centre de droit privé de l'ULB), sous la houlette de Benjamin Docquir et Andrée Puttemans, s'est une nouvelle fois associée avec le Barreau de Bruxelles pour organiser, le 8 décembre 2008, un module de conférences animées par des professeurs, chercheurs et praticiens qui sont parmi les meilleurs spécialistes du droit de la vie privée en Belgique. Le présent ouvrage reproduit leurs rapports écrits, particulièrement circonstanciés et à la pointe de la toute dernière actualité en la matière: 1) Le droit de la vie privée: aperçu général et règle de proportionnalité, par Benjamin Docquir, avocat et collaborateur scientifique auprès de l'Unité de droit économique de l'ULB. 2) Les enjeux de la vie privée au travail et sa dynamique dans l'entreprise, par Olivier Moreno, avocat et médiateur; assistant en droit du travail à l'ULB, et Sébastien Van Koekenbeek, attaché à la Chambre des représentants. 3) Transferts transfrontaliers de données: quelques considérations théoriques et pratiques, par Thierry Léonard, professeur aux Facultés Universitaires Saint-Louis, avocat et Anthony Mention, avocat. 4) RFID et Biométrie: État des lieux d'un point de vue de vie privée, par Virginie Fossoul, assistante à l'ULB et avocate.
