This edited collection, the result of an international seminar held at the International Institute for the Sociology of Law, Oñati, Spain in 2010, explores the potential legal and criminological consequences of climate change, both domestically and for the international community. A novel feature of the book is the consideration given to the potential synergies between the two disciplinary foci, thus to encourage among legal scholars and criminologists not only an analysis of the consequences of climate change from these perspectives but to bring these fields together to provide a unique, inter-disciplinary exploration of the ways in which climate change does, or could, impact on our societies. Such an inter-disciplinary approach is necessary given that climate change is a multifaceted phenomenon and one which is intimately linked across disciplines. To study this topic from the point of view of a single social science discipline restricts our understanding of the societal consequences of climate change. "The last decade has witnessed an increasing focus on the impact of climate change on the enjoyment of human rights. Several international human rights bodies have now recognised the negative implications of climate change for the enjoyment of the rights to life, food, health, housing and self-determination, among others, and regularly call on states to ensure the participation of women, indigenous peoples and other vulnerable groups in climate change-related actions. Yet despite this, there are still significant gaps in our understanding of the role of international human rights law in enhancing accountability for actions related to climate change. While accountability is central to human rights law and practice, in the context of climate change it has been undermined by a lack of clarity regarding a series of legal and practical questions. Other pressing questions are the relationship between international human rights law and the UNFCCC regime, and to what extent human rights bodies are competent to deal with cases related to climate change. This book offers a timely and comprehensive analysis of the issues related to accountability for the human rights impact of climate change, drawing on the state responsibility regime."

Few would dispute the power of climate change to lead to profoundly destructive weather events. At the same time, the possibility of climate change as a consequence—or even a cause—of criminal events is far less recognized. As the earth grows warmer, issues regarding land use, water rights, bio-security, and food production and distribution will continue to have far-reaching impact, and produce more opportunity for offenses by individuals and groups as well as political and corporate entities. Le droit international du climat a conduit les États du monde entier à adopter, depuis les années 2000, des lois portant sur la réduction et l'adaptation aux changements climatiques. Comme résultat de ce phénomène d'internalisation du droit international, des droits et obligations ont été progressivement affirmés au niveau domestique et invoqués par des acteurs très différents devant les tribunaux nationaux : soit pour contester leurs contenus (trop ou pas assez exigeants), soit pour enjoindre à l'État ou ses autorités d'aller plus ou moins loin (selon les requérants) et d'être plus ambitieux dans la planification des objectifs climatiques, ou encore afin d'engager la responsabilité des entreprises polluantes. Depuis, ce contentieux climatique s'est considérablement déployé tout en se diversifiant, d'abord aux États-Unis, mais désormais aussi en Europe et dans le reste du monde. Le procès climatique constitue un ensemble très hétérogène : des recours administratifs à la saisine des instances internationales et régionales, engageant la responsabilité d'une agence régionale ou d'un vaste groupe d'entreprises multinationales, demandant des réparations pour une seule victime ou pour un peuple entier, invoquant des impacts climatiques passés ou la violation des droits des générations futures. Les thématiques traitées dans ces procès sont vastes, abordant aussi bien la réglementation du droit climatique (mesures de réduction des gaz à effet de serre ou des mesures d'adaptation), que du droit de la responsabilité de l'État et de l'entreprise, soit par le droit civil ou le droit administratif. Les argumentaires des requérants mobilisent les notions de common law (Law of torts, Public Trust), les droits fondamentaux, les droits constitutionnels, le droit de l'environnement, mais aussi le droit des investissements, le droit des affaires, et ce à toutes les échelles internationale, régionale, nationale ou locale.Cet ouvrage a pour ambition d'analyser la complexité des procès climatiques mais aussi les enjeux essentiels pour le droit et pour les juridictions soulevés par ce contentieux encore émergent. Il constitue en grande partie des restitutions de certaines communications du premier colloque international sur les contentieux climatiques qui a eu lieu le 3 novembre 2017 à Paris. L'ouvrage est complété de contributions de spécialistes des contentieux climatiques et environnementaux.
