Abstract

When business leaders, government officials, and other stakeholders come to the table in an environmental, health, or safety dispute, acrimony often results, leading to expensive and time-consuming litigation. Not only does this waste precious resources, but rarely does the process produce the best outcome for any of the parties involved. For the past five years, the authors of this volume have conducted semi-annual seminars at the Massachussetts Institute of Technology and at Harvard to provide business leaders and regulators with the knowledge and skills they need to more effectively handle environmental, health, and safety negotiations. Their strategy, known as the "mutual gains approach," is a proven method of producing fairer, more efficient, more stable, and wiser results. Negotiating Environmental Agreements provides the first comprehensive introduction to this widely practiced and highly effective approach to environmental regulation. The book begins with an overview of the mutual gains approach, introducing important concepts and ideas from negotiation theory as well as the theory and practice of mediation. The authors then offer five model negotiations from their MIT-Harvard Public Disputes seminar, followed by a series of real-world negotiated environmental agreements that illustrate the kinds of outcomes possible when the mutual gains approach is employed. A collection of writings by leading experts provide valuable insights into the process, and appendixes offer both instructions for conducting model negotiation sessions and analysis of actual game results from earlier seminars. This is the only prescriptive text available for the many regulatees and regulators involved in environmental regulatory negotiations each year. Anyone involved with environmental negotiation -- including corporate and public sector managers, students of environmental policy, environmental management, and business management -- will find the book an essential resource.

Abstract

This book provides a comprehensive and up to date comparative study of the management and resolution of conflicts between conservation and recreation in protected areas in the US and China. Competing claims on the use of nature, increasing regulation of land use and recreational activities, and the conflicting goals between conservation and development have led to a rise in conflicts in the designation and management of protected areas. How to effectively manage and resolve these conflicts has become a challenge for both legislators and managers. By adopting an institutional dimension in legal interpretation, this book critically examines how such conflicts are dealt with in the legal regimes of the US and China while exploring interactions between legislatures, agencies and courts. The book searches for a plausible solution to improve the legal framework of protected areas in China by emulating pertinent mechanisms developed in the US, whilst also presenting legal and policy recommendations to the US. This informative book will be useful for legal scholars in Chinese law, nature conservation law, administrative law and comparative law.

Abstract

"The global spread of transnational mining investment, which has been taking place since the 1990s, has led to often volatile conflicts with local communities. This book examines the regulation of these conflicts through national, transnational and local legal processes. In doing so, it examines how legal authority is being redistributed among public and private actors, as well as national and transnational actors, as a result of globalizing forces. The book presents a case study concerning the negotiation of land transfer and resettlement between a transnational mining enterprise and indigenous peasants in the Andes of Peru. The case study is used to explore the intensely local dynamics involved in negotiations between corporate and community representatives and the role played by legal ordering in these relations. In particular, the book examines the operation of a transnational legal regime managed by the World Bank to remedy the social and environmental impacts of projects which receive Bank assistance. The book explores the nature and character of the World Bank regime and the multiple consequences of this projection of transnational law into a local dispute."--Bloomsbury Publishing.

Abstract

Conflicts frequently arise over environmental issues such as land use, natural resource management, and laws and regulation, emerging from diverging interests and values among stakeholders. This book is a primer on causes of and solutions to such conflicts. It provides a foundational overview of the theory and practice of collaborative approaches to managing environmental disputes.Joshua D. Fisher explains the core concepts in collaborative conflict management and presents a clear, practical, and implementable framework for understanding and responding to environmental disputes. He details strategies to bring stakeholders together in pursuit of collective solutions, emphasizing ongoing processes of dialogue, analysis, action, and learning. This collaborative approach can create new opportunities for stakeholders to better understand each other and the natural world, which enables more effective and context-appropriate environmental governance. The primer examines why and how system dynamics can constrain or expand the possibility of constructive management of conflicts. It features a case study from the Amazon Basin, where local communities, extractive industry operators, conservationists, and land managers have often clashed over access to natural resources, drawing out lessons to illustrate how to adapt the conflict management framework to distinct contexts.Managing Environmental Conflict synthesizes knowledge, methods, and practices spanning consensus building, collaborative governance, complex adaptive systems science, environmental conflict resolution, and environmental peacebuilding. Its presentation of this important and timely topic will be invaluable for academics and practitioners alike, including decision makers, scientists, and conflict management professionals.

Abstract

Environmental mediation continues to develop and evolve in different jurisdictions across the world in order to prevent potential environmental conflicts or to resolve the conflicts while avoiding the inherent drawbacks of an adjudicated solution. This book takes a comparative approach to explore the legal framework of environmental mediation with a focus on the judicial, administrative and private procedures and the criteria for accrediting mediators in a range of jurisdictions across the world. It also examines practical considerations for environmental mediators while analysing the effectiveness of different mediation processes.
