Rechtskultur ist ein zentraler Begriff in Recht und Gesellschaft. Was aber ist Rechtskultur? Wie entsteht Rechtskultur? Welche Facetten hat Rechtskultur? »Rechtskultur« ist ein Versuch, Antworten, Konturen und Strukturen zu entwickeln. Peter Mankowski will dabei keine Großtheorie aufstellen, sondern Zusammenhänge aufzeigen. Er bietet im Kern eine rechtsvergleichend-anekdotische Annäherung an einen schwierigen und vielschichtigen Begriff. Dabei will er Anstöße geben und anregen. Rechtskultur steht in gesellschaftlichen, religiösen und ideologischen Traditionen. Rechtskultur ist dynamisch. Sie muss versuchen, mit gesellschaftlichen, wissenschaftlichen und technischen Entwicklungen Schritt zu halten. Rechtskultur speist sich aus der Wahrnehmung der Laien, vermittelt durch Bilder in Medien, ebenso wie aus dem Selbstverständnis der Juristen. Rechtskultur bezieht sich auf den Einzelnen ebenso wie auf dessen Verhältnis zu Gemeinschaften. Rechtskultur zeigt sich in internationalen Kontexten. Rechtskultur ist so bunt und vielgestaltig wie das Recht und das Leben selber.

One of the great steps towards a European Private International Law and for the facilitation of transborder trade is the Rome I Regulation which europeanised the applicable law for international contracts throughout the Union (though except Denmark).This Regulation has to be applied since the end of 2009. It has moderately reformed and replaced the former Rome Convention which had already proven its practical value for over two decades as many national decisions and also judgments of the European Court of Justice evidence.It is therefore high time for a truly pan-European Commentary on the Rome I Regulation which takes account of the European nature of this instrument. This is reflected by the team of contributors that originates from all over Europe assembling first experts in their countries. Today car crashes, holiday accidents, damage through defective products and other tort situations, that occur in Europe, not infrequently involve a foreign element. It is then always of crucial importance which law applies. For the first time the EU has unified the private international law rules for extra-contractual relations in the Rome II Regulation. The instrument is in force in all EU Member States (with the only exception of Denmark) since 2009. Meanwhile the European Court of Justice and national courts have rendered a considerable number of decisions concerning central provisions of the Regulation. The time is therefore ripe for a truly pan-European Commentary on the Rome II Regulation which can give guidance in its interpretation. The magna charta of cross-border family law The Brussels IIbis Regulation is the magna charta of cross-border divorce and cross-border lawsuits concerning responsibility in Europe.
