Devant les meurtres collectifs, matérialisation de l'abolition du principe de la limite, quelles sont les réponses de la justice pénale internationale ? Cet ouvrage propose une nouvelle lecture des crimes contre l'humanité et des génocides. L'analyse criminologique des pratiques meurtrières révèle non seulement la manipulation des tabous du meurtre, de l'inceste et du cannibalisme mais également un agir génocidaire qui remet en question les fondements de la normativité des communautés humaines sur des valeurs éthiques. Face aux dits et non-dits des meurtres collectifs, la justice pénale internationale reproduit une rationalité imperméable à l'abolition du principe même de limites et de perpétuation des sociétés. Cet essai est une invitation à penser d'autres espaces de justice pouvant considérer d'une part les visions endogènes d'une justice territorialisée et d'autre part l'effondrement d'une perception de l'Humanité dévoilés par les meurtres collectifs et politiques. Maître de conférences à l'Université Paris Ouest Nanterre La Défense, enseignant également au Laboratoire d'Anthropologie Juridique de Paris (Université Paris I Panthéon-Sorbonne), professeure invitée à l'école de criminologie de l'Université de Lubumbashi en République Démocratique du Congo depuis 2006, Sara Liwerant est actuellement conseillère du Ministre de la Justice et des Droits Humains de la République Démocratique du Congo. Pénaliste, criminologue et anthropologue du droit et de la justice, elle a été rédactrice en chef de la Revue Droit et Cultures. Ses nombreuses publications portent sur les meurtres collectifs, la justice pénale internationale et le milieu carcéral. En effet, l'auteure a travaillé dans les prisons françaises, au Pérou sur la justice transitionnelle et à Brazzaville avec des acteurs de la guerre civile.

The volume consists of the introductory reports of the two Directors of Studies (Professor D. Momtaz of the University of Teheran and Professor M.J. Matheson of George Washington Law School), together with contributions by 13 of the Centre participants that were deemed to be particularly worthy of publication, an extensive bibliography and a general index. The topic for 2007 was "Rules and Institutions of International Humanitarian Law Put to the Test of Recent Armed Conflicts". It reflects the fact that international humanitarian law has gone through a period of considerable expansion and development in the past two decades, including the conclusion of several new international humanitarian law conventions and codes of offences, the creation of a number of criminal tribunals to prosecute international humanitarian law violations, and the effort by the ICRC to produce a comprehensive elaboration of customary law in the field. But the topic also reflects the fact that this body of law has been seriously tested by the armed conflicts of recent years, which have often been vast in scope, long in duration and severe in their human consequences. These conflicts have challenged both the norms themselves and the new institutions that have been created to enforce them.

"Since 2001, the Gacaca community courts have been the centrepiece of Rwanda's justice and reconciliation programme. Nearly every adult Rwandan has participated in the trials, principally by providing eyewitness testimony concerning genocide crimes. Lawyers are banned from any official involvement, an issue that has generated sustained criticism from human rights organisations and international scepticism regarding Gacaca's efficacy. Drawing on more than six years of fieldwork in Rwanda and nearly 500 interviews with participants in trials, this in-depth ethnographic investigation of a complex transitional justice institution explores the ways in which Rwandans interpret Gacaca. Its conclusions provide indispensable insight into post-genocide justice and reconciliation, as well as the population's views on the future of Rwanda itself"-- "This is a timely empirical study and review of the Gacaca Courts which were established in 2001 in Rwanda as an attempt to prosecute suspects involved in the 1994 genocide.
