In dit tweede deel van het Handboek gezondheidsrecht staat de beroepsbeoefening in de gezondheidszorg centraal. De nadruk ligt daarbij op het medisch handelen. Daarmee wordt niet voorbijgegaan aan de vele andere beroepsbeoefenaren die werkzaam zijn in de gezondheidszorg. De beroepsbeoefening vindt steeds vaker plaats in instellingsverband en in andere samenwerkingsrelaties, hetgeen ook zijn weerslag vindt in de jurisprudentie.De juridische aspecten van samenwerking krijgen daarom de nodige aandacht. Kwaliteit is daarbij het sleutelbegrip. Bij kwaliteit gaat het ook om de hulpmiddelen die in het kader van de beroepsbeoefening worden gebruikt. Daaraan is nu een afzonderlijk hoofdstuk gewijd. Verder wordt in dit deel ingegaan op hulpverlening in bijzondere contexten, zoals bij orgaantransplantatie. Daarnaast komen thema's aan de orde als bedrijfsgezondheidszorg, verzekeringsgeneeskunde en preventie. Pharmaceutical policy making raises particular challenges in reconciling key objectives for health policy, such as ensuring affordable access to the latest effective drugs, with other important policy considerations, such as providing support to a valuable national industry. Unusually among health policy issues, it also raises international considerations that further complicate decision making, particularly as the nature and extent of such considerations are not well understood. This report assesses how pharmaceutical pricing and reimbursement policies have contributed to the achievement of certain health policy objectives. It examines the national and transnational effects of these policies, in particular, their implications for the availability of medicines in other countries, the prices of these medicines, and innovation in the pharmaceutical sector. This publication presents an analysis of comparative price levels, making use of a unique dataset to construct the most comprehensive pan-OECD pharmaceutical price index to date. It also draws upon original case studies of pharmaceutical pricing and reimbursement policies in six OECD countries to provide specific examples of the impacts of policies on health system performance.

Un mélange de contributions de grand intérêt en droits des assurances, de la responsabilité civile, médical, commercial et européen La carrière de Jean-Luc Fagnart force le respect : tout en menant ses intenses activités d’avocat au barreau de Bruxelles, il a été successivement assistant du professeur Heenen, professeur ordinaire à la faculté de droit de l’Université Libre de Bruxelles, directeur du Centre de droit privé et de droit économique, directeur de la Licence spéciale en droit des assurances, directeur du DES en droit économique de l’ULB et président de la Chaire de droit des assurances de l’ULB. Il a enseigné le droit commercial à l’Ecole de commerce Solvay, le droit des assurances à la Faculté de droit de l’ULB et le droit de la réparation du dommage corporel à la Faculté de médecine de l’ULB. Il fut également chargé de conférences pour le droit européen des assurances à l’Université internationale de Luxembourg et professeur invité à l’Université de Paris XII. A ses fonctions d’avocat et de professeur, s’ajoutent de nombreuses participations en tant qu’expert dans l’élaboration d’études, de rapports et de nouvelles législations, particulièrement dans le domaine du droit des assurances, du droit médical, de la responsabilité et du droit de la consommation. Il est aussi conseiller suppléant à la Cour d’appel de Mons. Tout en discrétion et avec la modestie qui le caractérise, Jean-Luc Fagnart a contribué au développement du droit en tant que praticien et au travers d’innombrables contributions scientifiques sous la forme d’ouvrages collectifs, de monographies, d’études critiques, de chroniques de jurisprudence, de participations en tant qu’orateur à des congrès et à des colloques en Belgique et à l’étranger. Il est également membre de plusieurs comités de rédaction de revues juridiques. Ce liber amicorum lui sera offert lors d’une cérémonie d’hommage organisée le 23 octobre 2008. Cet ouvrage contient les contributions de nombreux confrères, collègues et amis de Jean-Luc Fagnart qui, chacun à leur façon, ont souhaité rendre hommage à son parcours professionnel impressionnant.
