À la demande d'amis et de collègues, Tancrède de Bologne rédigea entre 1214 et 1216 un traité destiné à fournir aux futurs juges et avocats des cours ecclésiastiques les éléments de procédure dont ils auraient besoin. Cet "ordo judiciarius" se distingue par son ampleur, sa clarté et ses innovations. Par une diffusion et une autorité exceptionnelles, il a contribué à stabiliser la procédure romano-canonique. Dès la première moitié du XIIIe siècle, en effet, il devient le manuel standard de procédure, ce qui lui vaut parfois le titre d' "Ordinarius". C'est d'ailleurs sous le titre d' "Ordinaire" qu'il s'est diffusé en français. La traduction française (1242-ca 1253) traduit un remaniement parisien du traité bolonais, qui cite une partie des allégations mentionnées dans la version originale et qui introduit des matériaux empruntés au "Liber extra" de 1234. Premier manuel de procédure en français, la traduction, anonyme, a connu une belle diffusion, dont témoignent dix manuscrits conservés. L'ambition principale de cette édition critique est d'offrir aux historiens du droit un texte accessible et établi d'après des critères ecdotiques scientifiquement acceptables. En effet, sans édition, l' "Ordinaire" ne peut être lu que dans des manuscrits dont le texte est fortement mutilé. L'intérêt de l' "Ordinaire" ne se limite toutefois pas au droit : cette translation est riche d'enseignements pour les historiens de la langue française, et notamment de son lexique, mais aussi pour les spécialistes de traduction. Plus généralement, les curieux saisiront combien la procédure décrite dans l' "Ordinaire" a informé des pratiques qui ont encore cours et toucheront du doigt un français juridique savant en pleine élaboration

This newest volume in the History of Medieval Canon Law series surveys the history of Byzantine and Eastern canon law. Beginning in the Patristic Age, Susan Wessel outlines the evolution of ecclesiastical law before the Council of Nicaea (325 A.D.). She covers the earliest documents and councils in the Christian tradition, and concludes that the councils replaced other sources of authority as bishops moved to a more democratic model of church organization. Heinz Ohme then offers a detailed analysis of the Greek councils and the writings of the Greek Fathers. He treats the sources of canonical material of Byzantine canon law down to the Quinisext Council (Trullanum, 692). Spyros Troianos presents a comprehensive survey of the Greek canonical collections and their compilers from the fourth to the eleventh century. In extending his coverage to 1500, Troianos provides bibliographical and biographical information about the most important Byzantine canonists who remain virtually unknown in English language literature: John Zonaras, Alexios Aristenos, and the Byzantine Gratian, Theodore Balsamon. With Hubert Kaufhold's contribution, the book also explores the wide range and variety of law in Eastern Christian communities, including Western Syrians (Jacobites), the Copts, Ethiopians, Armenians, Georgians, Nestorians, and Maronites.
