L'évolution du travail est celle d'une longue marche vers toujours plus de liberté. Car le salariat, caractérisé par la relation de subordination, a étouffé le travail dans un cadre trop rigide et coercitif, conçu à l'ère de l'usine. Door het sluiten van een arbeidsovereenkomst aanvaarden de werknemer en de werkgever dat ze een aantal rechten en plichten hebben ten opzichte van elkaar. De werknemer moet de arbeidstijd besteden aan de overeengekomen arbeid en moet handelen volgens de instructies van de werkgever, zoals afgesproken in de overeenkomst. Zowel in de private als publieke sector is de werknemer dus ondergeschikt aan zijn werkgever. Dat heeft onder meer tot gevolg dat de werknemer moet aanvaarden dat de werkgever hem binnen bepaalde grenzen controleert als een vorm van de uitoefening van zijn werkgeversgezag. Maar het recht op privacy van de werknemer eindigt niet aan de ondernemingspoort. Werknemers mogen wel degelijk redelijke privacyverwachtingen koesteren. Het grondrecht van de werknemer op privacy muteert in de onderneming. Het past zich aan de specifieke bedrijfsomstandigheden en aan de ondernemingscontext aan. In deze publicatie gaan we dieper in op de algemene en specifieke privacynormen die gelden voor de relatie tussen werkgever en werknemer, de sollicitant en de werknemer die de organisatie heeft verlaten.
