La pensée du théoricien allemand Jürgen Habermas figure parmi les plus importantes théories sociales issues du xxe siècle : toutefois, à ce jour, elle n’a inspiré qu’un nombre restreint d’études portant spécifiquement sur leur articulation à l’éducation moderne et contemporaine. Cet ouvrage présente ainsi une analyse critique de la façon dont la théorie de l’agir communicationnel développée par Habermas s’arrime à une étude macro et microsociologique de l’éducation, soit une analyse de l’organisation politique, économique et idéologique des systèmes éducatifs occidentaux depuis la modernité, puis une analyse intime et située des rouages de l’activité éducative entre l’enseignant et l’élève. Dès lors, comment réfléchir l’éducation passée et actuelle à l’aune de la pensée habermassienne, en profitant de ses apports tout en mettant en lumière les impasses qu’elle représente, notamment pour le développement du potentiel critique et communicationnel de l’enfant ? Il faut sans ambages se pencher sur la conception de modernité du droit que nous propose le philosophe allemand Jürgen Habermas. Il faut aborder, analyser et réfléchir sur la signification que nous pouvons accorder aux contributions philosophiques et théoriques qu’il nous offre tant sur le droit, la démocratie, la délibération politique que sur d’autres thèmes touchant encore la question juridique. Dans le paysage intellectuel, philosophique ou encore juridique de notre contemporanéité, Habermas est indubitablement un penseur incontournable et certainement le plus prometteur pour mettre les pendules à l’heure en ce qui concerne notre projet moderne et la possibilité de droit qui doit l’accompagner. En toute modestie, l’objectif est de relever le défi philosophique de penser le droit et la démocratie délibérative avec Habermas et, au-delà, de réfléchir de façon critique au sens à accorder à une modernité juridique en continuelle reconfiguration. Jürgen Habermas and John Rawls are perhaps the two most renowned and influential figures in social and political philosophy of the second half of the twentieth century. In the 1990s, they had a famous exchange in the Journal of Philosophy.
