On an unprecedented scale, nations at all income levels and across the political spectrum have initiated privatization programs over the past twenty years. In the course of this privatization movement, microeconomic efficiency arguments have become the standard justification for the divestment of public assets. Why Do Governments Divest? The Macroeconomics of Privatization presents an alternate view. This book argues that short-term macroeconomic considerations are often the true motive behind privatization programs, allowing politicians to exploit privatization for political gain by manipulating macroeconomic aggregates. Macroeconomic considerations can also influence the nature of privatization efforts, delaying necessary reforms in an effort to prevent undesirable short-run consequences. This focus on short-term objectives tends to hinder the achievement of economic efficiency and to impede progress towards higher living standards.

Longtemps, le phénomène de la décentralisation par services s'est manifesté en empruntant les formes juridiques classiques de la loi du 16 mars 1954 " relative au contrôle de certains organismes d'intérêt public ". L'essor de l'initiative économique des pouvoirs publics a ensuite amené le législateur à mettre sur pied de nouvelles structures, permettant aux organismes actifs dans des secteurs industriels et commerciaux de faire face à un environnement concurrentiel. Dans les années '90, les entreprises publiques autonomes sont donc nées, aux côtés des traditionnelles régies et organismes d'intérêt public. Dans ce contexte, le contrat de gestion est devenu un instrument privilégié pour combiner les exigences, à la fois essentielles et contradictoires, d'autonomie et de contrôle qui caractérisent la décentralisation fonctionnelle. Actuellement, le régime juridique applicable aux parastataux évolue et se complexifie, sous l'influence de divers facteurs. Dans le cadre de la fédéralisation du pays, les communautés et les régions se sont vu reconnaître une autonomie qui les habilite à créer des pararégionaux et paracommunautaires, en déterminant pour chacun leur forme juridique. De multiples agences, sociétés de droit public ou organismes ad hoc voient ainsi le jour aux quatre coins du pays. Et les administrations, tant fédérales que fédérées, (re)découvrent les potentialités en termes d'autonomie de formes d'organisation sans personnalité juridique propre, comme les services à gestion séparée. Par ailleurs, le droit européen de la concurrence, des aides d'Etat et des marchés publics oriente de plus en plus la définition des structures de décentralisation fonctionnelle. Enfin, les formes juridiques de droit privé - telles les associations sans but lucratif - connaissent, en raison de leur apparente souplesse, un regain d'intérêt au delà même de la sphère des pouvoirs locaux où elles ont toujours connu le succès. L'objet de cet ouvrage est de faire le point sur ces évolutions récentes, sans perdre de vue leurs conséquences notamment sur les règles de contrôles politiques et juridiques exercés sur les organismes décentralisés, sur les dispositifs relatifs à la gouvernance publique, ainsi que sur la relation et le régime de travail du personnel.
