"Utilise en Afrique du Sud pendant l'Apartheid par les prix Nobel de la paix Nelson Mandela et Desmond Tutu, le mot ubuntu désigne un idéal de société opposé à la ségrégation, instrument promouvant la réconciliation nationale. Une notion voisine des concepts occidentaux d'humanité et de fraternité. Popularisé par des intellectuels sud-africains, comme principe directeur de la "Commission Vérité et Réconciliation", instituée en 1995 pour assurer la liquidation de l'apartheid, le concept "Ubuntu" est depuis repris en compte dans des domaines aussi divers que la philosophie, la théologie, l'industrie numérique, le management, la sociologie politique... Issu de la famille des langues africaines dites bantu (ou bantoues), le terme "ubuntu" ne devrait être compris, selon l'auteur du livre, que dans l'univers de ces langues. Il revisite ainsi les données ethnologiques, à travers la linguistique et la philosophie, avant d'examiner la notion d'ubuntu dans la perspective sud-africaine de la théologie du pardon. L'étude passe également en revue les travaux des rhétoriciens français ayant évolué à l'Université de Cape Town en Afrique du Sud, examine le passage à la métaphore d'ubuntu comme système d'exploitation dans l'univers numérique, et comme stratégies de mise en place d'un leadership et d'un management enracinés dans la culture africaine. "Ubuntu is an African philosophical tradition that embodies the ability of one human being to empathize with another. It is the quintessence of African humanism, communalism, and belonging. As the late Archbishop Desmond Tutu anticipated, Ubuntu resonated with the moral intuition of the majority of black South Africans in the 1990s. As a result, it became the foundational ethical basis for articulating a new post-apartheid era of reconciliation and forgiveness in the face of a history marked by brutal racial violence. Yet Ubuntu, as a philosophy or ethical practice which has arguably come to represent African humanism and communalism, has not been sufficiently assimilated into contemporary philosophical scholarship.00This anthology weaves interdisciplinary perspectives into the discourse on African relational ethics in dialogue with Western normative ideals across a wide range of issues, including justice, sustainable development, musical culture, journalism, and peace. This book argues for the existence of a court enforceable human right to water that is implied from the right to life in Article 6 of the Namibian Constitution.The book builds this argument by using tools of constitutional interpretation and with the aid of comparative materials. As such, the African value of ubuntu is invoked. Ubuntu – which is legally developed through its four key principles of community, interdependence, dignity and solidarity – is anchored in a novel approach to Namibian constitutional interpretation that is conceptualised as ‘re-invigorative constitutionalism’. The book advances the ‘AQuA’ (adequacy – quality – accessibility) content of water and articulates the correlative duties within the context of the respect – protect – fulfil trilogy, which are duties imposed upon the Namibian state as the primary duty bearer for a right to water. These duties include irreducible essential content duties that are argued to be immediate when compared to general obligations. In giving substance to duties that flow from a right to water, international law interpretative resources are also relied upon, including General Comment No 15 by the United Nations Committee on Social, Economic and Cultural Rights, the African Commission’s Principles and Guidelines on Social and Economic Rights, and the World Health Organisation’s Drinking-water Quality Guidelines. Moreover, the book addresses various justiciability concerns that may arise, arguing that Namibian courts are institutionally competent and legitimate in enforcing right to water claims through the application of the bounded deliberation model. Additionally, because the Principles of State Policy in Article 95 of the Namibian Constitution are rendered court unenforceable by Article 101, the argument is made that this does not undermine the claim that a right to water, anchored in the right to life, can be enforced through the courts.
