Abstract

Les parlements nationaux ont longtemps été considérés comme étant les grands perdants de l'intégration européenne qui a principalement été le fait des gouvernements des États membres. Toutefois, le Traité de Lisbonne, entré en vigueur en 2009, a, pour la première fois, reconnu leur importance en leur attribuant directement certaines prérogatives parmi lesquelles la possibilité de contrôler le respect du principe de subsidiarité. Ce changement de paradigme, intervenu au niveau européen, a requis certaines transformations, au sein des États, afin que les parlements puissent faire usage de leurs nouveaux droits. Cet ouvrage étudie ainsi comment les parlements - nationaux et régionaux - allemands, britanniques, espagnols, français et italiens se sont adaptés à ce nouveau contexte. On se demande également si ces modifications ont permis que les parlements cessent, enfin, d'être en marge des affaires européennes tant dans leur propres États que dans le cadre de l'Union. Cette étude est originale en ce sens, comparant cinq États membres ; elle dresse un véritable bilan de la pratique postérieure au Traité de Lisbonne, cinq ans après son entrée en vigueur.--

Abstract

"At first sight, it would appear as though the question of the definition of membership to the European Union (EU) is superfluous. The Treaty on EU unequivocally defines in its article 1 that the contracting parties are the Member States of the EU. However, closer examination could cast some doubt on this unitary status of Member States, or at the very least it could reveal that it needs nuancing. Whilst diversity and to some extent differentiation or even fragmentation have been part and parcel of the European integration process since its very beginning, several developments invite to a new reflection on membership within the EU and relatedly on differentiation in and outside the EU today. This is what the contributions to this edited volume propose"--

Abstract

This volume addresses an important aspect of Brexit that has been ever-present in public debates, but has so far not received corresponding attention by academic scholars, namely the role of parliaments and citizens in this process. To address this gap, this book brings together an international group of authors who provide a comprehensive and multidisciplinary treatment of this subject. Specifically, the contributors, scholars from the UK and across Europe, provide diverse accounts of the role of regional, national and European parliaments and citizens from the perspectives of Law, Political Science and European Studies. The book is structured in three parts focused on developments, respectively, in the UK, in the parliaments of the EU27, and at the EU level. Beyond providing a comprehensive examination of the scrutiny of Brexit, the book utilises the insights gained from this experience for a study of executive-legislative relations in the European Union more generally, examining the balance, or lack thereof, between governments and parliaments. In this way, the book also speaks to some of the long-lasting, indeed perennial questions about the effects of constitutional provisions and political practice in the context of European democracy. Thomas Christiansen holds a Chair in European Institutional Politics at Maastricht University, the Netherlands and is Co-Director of the Centre for European Research in Maastricht (CERiM). He is Executive Editor (with Simon Duke) of the Journal of European Integration and has published widely on the politics of the European Union. Diane Fromage is Assistant Professor of European Law at Maastricht University, the Netherlands and Research Coordinator at the Centre for European Research in Maastricht (CERiM). Her research mainly focuses on parliaments in the European Union, fiscal councils and the European Central Bank.

Abstract

This book considers national parliaments’ and the European Parliament’s role in European Union (EU) economic governance. It examines the recent strengthening of parliamentary involvement, limitations to improvements, and where and how democratic deficits still exist. It also provides the basis for some reflections concerning possible future evolutions and improvements to EU economic governance.The EU’s economic governance framework has been significantly strengthened as a response to the 2008 economic and financial crisis, and the establishment of a new Banking Union in 2013. It is thus key to determine whether these additional transfers of powers to the EU level have been accompanied by an equivalent empowerment of the national and European legislatures, allowing them to ensure adequate democratic legitimation. The chapters comprehensively re-examine the democratic (throughput) legitimacy of, and within, the EU’s economic governance by focusing on national parliaments, on the European Parliament, and on mechanisms for interparliamentary cooperation

Abstract

"Has executive predominance in EU-related matters disappeared ten years after the entry into force of the Lisbon Treaty? How have executive-legislative relations in the EU evolved over a crisis-ridden decade, from the financial and migration crises, to Brexit or the latest covid-19 pandemic? The Lisbon Treaty could be expected to lead to the re-balancing of powers in favour of parliaments, for it significantly enhanced the roles of both the European Parliament and national parliaments. A decade later, the contributions to this edited volume examine, for the first time in such an extensive breadth and from a multi-level and cross-policy perspective, whether this has actually materialised. They highlight that diverging tendencies may be observed, and that important variations over time have occurred, depending particularly on the occurrence of crises.
