La procédure d'asile en Belgique a été radicalement modifiée par les lois du 15 septembre 2006 entrées en vigueur le ter juin zool. Un an après l'entrée en vigueur de cette réforme, cet ouvrage fait le point sur la protection internationale des réfugiés en Belgique. Quel est son fondement en droit international, quelles sont les règles qui régissent la procédure applicable, mais surtout qui peut s'en prévaloir ? Après avoir retracé la genèse de l'émergence d'un droit international des réfugiés puis du processus d'harmonisation européenne qui, dans cette matière également, revêt une importance de plus en plus prégnante, l'ouvrage dresse l'état des lieux de la protection juridique dont peuvent se prévaloir les réfugiés en Belgique. Les questions de procédure sont d'abord examinées, sous trois angles: d'où vient-on ? Quelle est la procédure applicable aujourd'hui ? Quelles sont les conditions formelles pour former un recours contre une décision de rejet ? Le reste de l'ouvrage a pour principal objet de fournir aux praticiens une synthèse de l'état de la jurisprudence. L'interprétation de la définition du réfugié a, en effet, donné lieu au fil des ans à d'importants développements jurisprudentiels en Belgique, qui placèrent souvent notre pays à la pointe des pays membres de l'Union Européenne dans ce domaine du droit, mais qui n'avaient jusqu'à présent jamais fait l'objet d'un présentation synthétique. Ce livre s'efforce de combler cette carence. Le droit des réfugiés n'apporte pas la réponse à toutes les questions posées par les phénomènes de flux migratoires. Il n'offre qu'un remède très partiel et très insatisfaisant aux violations des droits humains de par le monde. Mais il a le mérite d'exister et ce n'est pas peu. L'ambition de cet ouvrage est de permettre au lecteur averti et moins averti d'en comprendre mieux la portée comme les limites.
