Abstract

Sara R. Farris examines the demands for women's rights from an unlikely collection of right-wing nationalist political parties, neoliberals, and some feminist theorists and policy makers. Focusing on contemporary France, Italy, and the Netherlands, Farris labels this exploitation and co-optation of feminist themes by anti-Islam and xenophobic campaigns as "femonationalism." She shows that by characterizing Muslim males as dangerous to western societies and as oppressors of women, and by emphasizing the need to rescue Muslim and migrant women, these groups use gender equality to justify their racist rhetoric and policies. This practice also serves an economic function. Farris analyzes how neoliberal civic integration policies and feminist groups funnel Muslim and non-western migrant women into the segregating domestic and caregiving industries, all the while claiming to promote their emancipation. In the Name of Women's Rights documents the links between racism, feminism, and the ways in which non-western women are instrumentalized for a variety of political and economic purposes.

Abstract

"Traditional international human rights law, with its focus on the state both as protector and (potential) violator, lacks an important dimension, namely individual criminal liability and mechanisms to ensure accountability in order to respond to serious human rights violations. This was seen as an evident weakness of the system that had remained unaddressed since the Nuremberg and Tokyo trials. However, a change in political constellations following the end of the Cold War, the establishment of ad hoc tribunals by the UN Security Council (UNSC) in the 1990s in response to the conflict in the former Yugoslavia and the genocide in Rwanda, strong NGO movements, and the leadership of several states resulted in the reemergence of international criminal justice efforts. This culminated in the establishment of the International Criminal Court (ICC) in 1998 and led to the setting up of several mixed/hybrid courts, such as those in East Timor, Cambodia and Sierra Leone.74 In an important broadening of the scope of international criminal law, the statutes of international tribunals recognise that war crimes can 73 See on relevant developments and jurisprudence, Chapter 8.6. 74 See on international criminal law generally, A. International human rights law has also become increasingly important in the context of international refugee law, such as in respect of the interpretation of the notion of persecution, immigration detention, and the scope of the prohibition of refoulement.77 At the national level, meanwhile, the end of conflicts and/or authoritarian systems has triggered complex processes often referred to as transitional justice.78 These processes are characterised by the agreed upon need to address legacies of violations in times of transition. Abstract

In all parts of the world, the implementation of women's human rights is seriously being hindered by gender stereotypes, religion, custom or tradition, in short by 'culture'. Culture is increasingly being used as an excuse to commit serious violations of these rights. It is also brought forward as the reason why governments refuse to implement them, arguing that their culture forces them to accept limited interpretations of international obligations in this area, or to reject such obligations altogether. This book provides women's human rights advocates with dissuasive arguments and effective strategies to avoid a deadlock between on the one hand upholding the principle of universality of human rights, and on the other hand the right to preserve and express one's culture.
